What clause can I put in my divorce decree that prevents my ex from modifying the custody agreement in future? |
I am amidst a divorce and my ex-husband has agreed to give me 100% custody. I fear he may seek to modify our child custody agreement in the future. I've heard there is a clause which prevents this. What is it? There is no clause you can put in the decree that prevents him from petitioning the court for a modification. No such thing. Any party can petition the court in the future to modify a custody agreement. No such a clause. I don't think that's possible. Someone always has the right to request a change in a divorce/custody agreement unless they volunteer to give up that right. NONE! Not anything legally binding. |
