			<content:encoded><![CDATA[<p>Like most insurance policies, motor vehicle accident (MVA) insurance is something you “have”, but tend not to investigate until you need it. Policies vary in coverage and amounts paid should an accident occur. Although no policy is complete, anyone injured in a MVA is entitled to certain benefits no matter who was at fault.Under the Canadian No-fault law, car accident victims are allowed to sue the other party for damages in addition to the insurance settlement. Insurance companies pay benefits out according to the Statutory Accident Benefits Schedule (SABS), but these payments may not be enough to remedy expenses in a fault MVA. In the rare case that neither party has insurance, the Motor Vehicle Accident Claims Fund takes care of the injured party’s expenses.Expenses covered are: * Loss of Income. If injuries sustained from the accident prevented you from working at your job, the income lost during the recovery period may be reimbursed. Under the Insurance Act, parties are eligible for up to 80% of their net income from accident to trial and up to 100% gross income loss after trial. * Medical Expenses. Any medical costs incurred. This includes rehabilitation. * Attendant Care Expenses. After being injured and then released from the hospital, you may require the help of a nurse or other professional. MVA payments cover this. * Additional Expenses. Expenses relating to the treatment of injuries sustained during an MVA such as travel costs, any prescribed apparatus, and other costs incurred because of the injuries.Consulting with your lawyer after an accident is the best way to figure out what you are entitled too. The means of tabulating damages can be complicated and an experienced Canadian lawyer will have a good idea of what settlement you deserve. They will guide you on what to do if your insurance company wants a statement or the other party’s insurance company wants to talk with you among other issues.It is best to be proactive about your MVA insurance policy. Before an accident occurs, find a lawyer to discuss what is and is not covered and what coverage would be best for you. A little preparation goes a long way and a simple consultation can help ease the mind over one’s safety if an accident ever does occur. </p>

			<content:encoded><![CDATA[<p>In Canada the Employment Insurance (EI) provides financial assistance to citizens who have lost their jobs. The working scheme of EI is similar to car insurance while you work you pay premiums to be entitled to benefits. To get EI you need to work for a certain period called qualifying period and you must have lost your employment through no fault of your own. You can start gaining benefits right after you lost your job and the maximum benefit is set at 55% of your insurable earnings. EI is governed by the Employment Insurance Act R.S. 1996 c. 23, and run by Human Resources and Skills Development Canada (HRSDC). </p>
<p>As for the wok that is insured it is the most work in Canada. You can’t be insured if you work for government of a province or foreign country, if you work for a family member (still in some cases it is possible to get EI in this situation), if you are a large shareholder of a company you work in, if you are employed on an entirely casual basis. Generally the qualifying period is set at 52 weeks from your last claim, in case you miss hours due to illness, injury, education, or incarceration, the period will be extended. If you were fired from your job for misconduct or left the job for no reason you won’t get EI. But if you lost your job for a reason beyond your control you can apply for insurance, it also provides possibilities to qualify for maternity, child care, compassionate care, and sick leave benefits. When you apply for EI be sure to present Record of Employment (ROE) from your last employer, it will show the reason why your employment ceased.  </p>
<p>After you have received EI there is a number of limitations and rules that you must follow. You receive payment only for days when you are available for work (no holidays etc.) and you are obligated to look for work while unemployed. If you refuse to look for work or accept an offer of suitable Canadian employment the payments will be ceased. As an example of not suitable work: if the offered work is in your field but has a lower wage or under less favorable conditions it can be considered not suitable. HRSDC also provides certain programs that must be attended, if you fail to visit the meetings the payments will be ceased. </p>
<p>As in any civilized country in Canada you can make an appeal if you disagree with determination made under the Act. You need to make an appeal to the Board of Referees within 30 days. An appeal can be made if the Board&#8217;s decision was contrary to the principles of natural justice, if it was based on an error of Canadian law, or made on the basis of incorrect and contrary facts. It is always useful to consult a labor and employment lawyer before making an appeal. If the decision of the Board of Referees does not satisfy you, you can appeal to Federal Court Judge within 60 days. </p>

It took about hundred years and the cars rapidly multiplied in numbers, becoming an important element of our everyday life. Unfortunately they became not only a useful thing, but also made their own death toll and turned even the smallest road a pretty dangerous place. The worst part of the accidents is definitely driving under the influence of better to say drunk driving, as you will see in this article even the smallest changes in laws on drunk driving can lead to heated debates.The first rules regulating the driving under the influence were set with the Criminal Law Amendment Act, 1968-69, also known as Bill C-150. The bill made it a &#8220;per se&#8221; offence to drive with a blood alcohol content (BAC) in excess of milligrams of alcohol in 100 milliliters of blood. Also the Bill stated that a refusal of a police officer&#8217;s demand to provide a breath sample is an offence too. Still the drivers managed to handle small over the norm alcohol level with &#8220;two-beer&#8221; defense. The idea of this defense is following, people accused of driving with more than the norm set by the law (.08 milligrams of alcohol in 100 milliliters of blood) would often argue they had consumed just two beers. Also a popular statement is that the last beer was consumed not long before the breath test, so there is more alcohol in their breath than in their blood.An often used driver &#8220;two-beer&#8221; defense has been virtually abolished by a new federal legislation. The new changes, that are part of the federal government&#8217;s Tackling Violent Crime Act, kept the right to question the breathalyzer results, but only if the person provides the court with technical evidence proving the equipment was malfunctioning or wasn&#8217;t operated properly.Some lawyers stated that the new legislation is unconstitutional and they will appear before the Superior Court of Justice in Toronto to present their arguments. They try to resolve thing quickly, before the government can get on with the business of prosecuting impaired drivers. The main argument is that with this change divers will be unable to protect themselves if the equipment is really damaged or malfunctioning. Usually drivers don’t know much about breathalyzers and they won’t be able to present valid evidence to the court. Also the information of the breath machines, including maintenance records, specs and the manufacturers’ manual are kept secret and not available to casual driver who is stopped on the street. This turns a useful tool into a one-way guilty ticket, in case of malfunctioning.On the other side this change is positive for the police officers. Usually they are in a difficult situation. Some of the officers stated that they rely more on temporary license suspensions and not on the charges against drivers slightly over the limit, because the &#8220;two-beer&#8221; defense can easily beat these charges. </p>

			<content:encoded><![CDATA[<p>The Criminal Law Amendment Act, 1968-69 was introduced as Bill C-150 by then Minister of Justice Pierre Trudeau in the second session of the 27th Canadian Parliament on December 21, 1967. It passed third reading in the House of Commons after heated debates by a vote of 149 (119 Liberals, 18 New Democrats, 12 Progressive Conservatives) to 55 (43 Progressive Conservatives, 11 CrÃ©ditistes, 1 Liberal) on May 14, 1969. It introduced major changes to the Criminal Code of Canada and it was literally a cornerstone of modern Canadian law. The bill decriminalized homosexuality, allowed abortion and contraception, and regulated lotteries, gun possession, drinking and driving offences, harassing phone calls, misleading advertising and cruelty to animals. This year it will be the 40th anniversary of the bill&#8217;s passage.Homosexuality was one of the biggest problems of the Bill-150. This change was influenced in the late 1960s by the British Parliament&#8217;s adoption of the Sexual Offences Act 1967, which decriminalized homosexual acts in England and Wales. Naturally Canada wanted to follow this democratic decision. The biggest opposition was from the religious people, the Catholic CrÃ©ditistes of Quebec held up debate for three weeks supported by the far-right Edmund Burke Society and the Fellowship of Evangelical Baptist Churches in Canada. Still at the end homosexuality was legalized with age of consent at 21; although it was later lowered to 18.Contraception and therapeutic abortion under certain conditions were legalized by the bill. This was a step away form the influence of the Catholic Church&#8217;s moral positions on these issues, basically one more separation of the Church and State. Bill C-150 made it legal for women to get an abortion if a committee of three doctors felt the pregnancy endangered the mental, emotional or physical well-being of the mother. These changes were very important and became a stepping stone for many other freedoms and options that have altered women&#8217;s place in Canadian society. In 1988 the R. v. Morgentaler ruling, left Canada without any laws regulating abortion.A number of minor but important changes were made to gambling, gun control and driving under the influence. Before the bill small scale gambling on behalf of charities was permitted, but only Bill C-150 gave the provincial and federal governments the opportunity to use lotteries to fund worthwhile activities, the best example were the 1976 Montreal Olympics. For the first time the bill made it illegal to provide firearms to persons of &#8220;unsound mind&#8221; or criminals under prohibition orders. The term &#8220;firearm&#8221; was also expanded; non-restricted, restricted, and prohibited firearm categories were also introduced. Bill C-150 made it a &#8220;per se&#8221; offence to drive with a blood alcohol content (BAC) in excess of 80 mg/100 ml of blood. The refusal of a police officer&#8217;s demand to provide a breath sample was made an offence too. These are the basic rules against drunk driving now.The Criminal Law Amendment Act 1968-69 basically changed almost all the complicated and important spheres (except for maybe immigration) and solved many ethical problems, creating laws suitable for modern society. </p>

			<content:encoded><![CDATA[<p>Consumer Laws or better to say consumer protection laws are designed to solve two problems: to keep the businesses and manufacturers from providing the customers with false or fake information about the product on the one side and protect the rights and interests of consumers who purchased defective goods for example, on the other. With Consumer Laws the government regulates fair competition on the market by limiting the advertising of products only to facts. Also these laws protect the health of the nation by forcing the manufacturers to keep the quality as high as possible. Beside the government there are also large numbers of non-government organizations and individuals that participate in consumer activism and protect the rights of the consumer. There are two acts that regulate the Consumer Rights regarding products in Canada: the Hazardous Products Act and the Food and Drugs Act. The first act creates the safety standards for manufacturing of various products, the second act regulates the sale of food, drugs, cosmetics and medical devices. </p>
<p>It is very frustrating when you purchase an unsafe or defective product. Today such cases are mostly solved in stores, by replacing the defective product. Still if the problem remains unresolved it is the best time to take legal action, but before doing it, it’s better to prepare the lawsuit carefully. You need to be aware that in some cases the manufacturer or the seller will try to prove that you knew about the defect but continued to use the device anyway. Sometimes the manufacturer or seller simply doesn’t want to replace the product for financial reasons, sometimes because the defective product is ruining the reputation of the company or the product. Still there are a number of companies that provide additional warranties as a part of its consumer policy. </p>
<p>The main advantage of any consumer laws is that you can unite your claim with similar claims in the whole country, province or your area and turn it into a class action lawsuit. A good base for a lawsuit is injury caused by the defective product, in this case the court will most definitely award money to the injured person if they agree that the manufacturer or seller negligently sold a defective product. The rules regarding consumer claims are different in every province. Mostly the limit for a small claim in Canada is set at twenty thousand dollars. Small claims also do not require a lawyer, but there is a consumer lawyer that can always assist you in the case. For lawsuits with large compensations the lawyer becomes necessary. In case of large lawsuits it is sometimes too expensive for one person to handle and in this case the class action lawsuit is the best solution. All the expenses will be divided between people who file a large lawsuit together. The rewards will be divided too. And as in many other types of claims be sure to do one important thing before you file the claim, be sure to discuss it with your lawyer. </p>
