The 2008 Presidential Election, the Highest Rated Show in Entertainment Today – a Newport Beach, and San Diego Entertainment Attorney’s View

For a Palm Springs, Los Angeles, San Diego, and Newport Beach and Orange County entertainment lawyer, there has been nothing to compare to the drama of the 2008 election. If nothing else, the entertainment value of this election has been able to keep people’s minds off the economy. Everyone has something to watch for.

Will one candidate improve business conditions in San Diego or Orange County more than the other? Will the Vice Presidential pick be able to swing voters in one industry or another over the other candidate’s vice presidential pick? What new slimy negative attack ad is one candidate using to unfairly tear down the other and divide the county?

If it weren’t for politics right now, there would be nothing to be excited about in the entertainment field. Saturday Night Live ratings have gone through the roof because of one thing, politics. Their spoofs on the election have so much interest that they now have shows on Thursdays and Saturdays.

All the usual suspect celebrities who are usually in the news getting into scraps at night clubs, being arrested, having children, selling baby photos, gaining weight, losing weight, all seem to be behaving themselves.

So as an entertainment attorney, I have to say, thank goodness for politicians. Politics which used to be the stuff of boring discussions and something you would never discuss on a first date, is suddenly the topic of the day. And talk about drama….

The first thing we hear as we get home from work and turn on the TV is that the economy is about to sink into a deep hole and if we don’t give $700 billion on top of the almost $400 billion we’ve already spent on financial institutions, life as we know it will disappear. I would have only imagined such dire consequences before this announcement if aliens were about to invade and we needed $700 billion to build the largest ray gun. But this announcement wasn’t on a remake of War of the Worlds, it was on the news, on CNN, and everywhere.

And then there was the drama of working out the bailout plan. It’s on, it’s off. There’s been a breakthrough. Oops, spoke too soon. The McCain campaign is being suspended. Nope, wrong again. Then the bailout is passed and Europe goes into a tailspin almost as fast as Sarah Palin’s star is fading and John McCain’s campaign is headed for the dumpster. Then the negative campaigning starts in earnest.

Suddenly nobody cares what the greatest box office movies were for the week. Are they even showing movies anymore? This political drama is too good to miss. Besides, who can afford the popcorn and drinks at the movies anymore?

Now people are rushing home to see the latest poll numbers and to see the latest skits on Saturday Night Live. What zingers will the candidates have for each other? Will Sarah Palin be able to answer a question better than her rambling ludicrous answers she gave to Katie Couric? Is Letterman going to keep skewering McCain.

And you have the polls that are like following a horse race. First one candidate is ahead by a nose, and then the other is by a whisker. Then one candidate turns on a burst of speed as the other rushes for the wire.

This beats a close football game by a mile.This election has everything and they say they always save their best ads for the last. Don’t you dare touch that dial. This is entertainment for the ages.

What New Artists and Musicians Can Do to Keep From Being Taken Advantage of – See a California Music & Entertainment Lawyer

There is probably no other profession than the music business where so many people will try to take advantage of you when you are starting out as an artist or musician if you don’t have a lawyer. Whether you or your band hails from Carlsbad, Encinitas, Del Mar, Solana Beach in San Diego, Anaheim or Santa Ana in Orange County, or Palm Springs, whether you developed your talent in La Jolla, or at Huntington Beach, Laguna Beach or Santa Barbara, and whether you live, studied or performed in Hollywood, Westwood, Santa Monica, Venice, Malibu, Palm Desert or La Quinta, when you are just starting out, the entertainment industry sees you as someone whom they can take advantage of.

My advice to musicians just starting out and being presented with any type of contract is that having their contract reviewed by a music lawyer is essential. You are likely being presented with the most one-sided type of contract in any business or profession. They are written by the attorneys for the company or manager who is handing it to you with absolutely no attempt to be even handed.

Worst of all, at this stage in your career, you have little leverage. No matter how good you think your music is, the music world is littered with great musicians who signed horrible contracts that stifled if not ended their careers. Why Sarah Palin is the Best Darn Comedy on TV Today – a Newport Beach Entertainment Attorney’s View

It really doesn’t matter if you are Republican, Democrat or Independent, whether you live or work in Hollywood, Los Angeles, or live in Malibu, or live and work outside the entertainment industry anywhere from Orange County to San Diego, from Carlsbad, or Pacific Beach, La Jolla, Rancho Santa Fe and San Marcos to Newport Beach, Laguna Beach or Huntington Beach, Garden Grove, Anaheim, Irvine or Yorba Linda. Even if you live in Montecito or Santa Barbara, Temecula, Palm Desert, La Quinta or Palm Springs, you have got to love Sarah Palin for the comedy she has brought back to television and to this election. 

 

Before I even start this article, there will be some out there who will say Sarah Palin is being picked on. Whether or not you believe that to be true or false, this candidate is giving us some of the best comedy a politician has ever given us, and at a time when we have never needed it more. Saturday Night Live could never have hoped for a better candidate to skewer.

 

Who knew that the straight man or in this case straight woman would turn out to be Katie Couric?

 

First there was Sarah Palin’s attempt to explain her position that by the fact that Alaska is geographically close to Russia, that she has foreign policy experience. Couric asked why Palin’s experience in Alaska enhances her foreign policy credentials.

 

Palin: Well, it certainly does because our next door neighbors are foreign countries, there in the state that I am the executive of. And there in Russia –

 

Couric: Have you ever been involved in any negotiations for example, with the Russians?

 

Palin: We have trade missions back and forth. We do – it’s very important when you consider even national security issues with Russia – as Putin rears his head and comes into the airspace of the United States of America, where do they go? It’s Alaska. It’s right over the border. It is from Alaska that we send those out to make sure an eye is being kept on this very powerful nation, Russia, because they are right there, they are right next to our State.

 

Has anyone yet figured out what any of her answer to Katie Couric’s question means? One has to believe she was testing her skill as a deadpan comedian because she followed up this answer with an even better answer.

 

Couric: Why isn’t it better, Governor Palin, to spend $700 billion helping middle-class families who are struggling with health care, housing, gas and groceries; allow them to spend more and put more money into the economy instead of helping those big financial institutions that played a role in creating this mess?

 

Palin: That’s why I say I, like every American I’m speaking with, we’re ill about this position that we have been put in where it is the taxpayers looking to bail out. But ultimately, what the bailout does is help those who are concerned about the health care reform that is needed to help shore up our economy, helping the – it’s got to be all about job creation, too, shoring up our economy and putting it back on the right track. So health care reform and reducing taxes, and reigning in spending has got to accompany tax reductions and tax relief for Americans. And trade, we’ve got to see trade, as opportunity not as competitive, scary thing. But one in five jobs being created in the trade sector today, we’ve got to look at that as more opportunity. All those things under the umbrella of job creation. The bailout is a part of that.

 

Political science majors in college and election campaign advisors will be studying both of these answer for years. But just grasp if you will how, in her second answer,she is able to connect the dots. The bailout, Palin says, makes her and other Americans ill. So the bailout needs to bail out health care, presumably, so we can get over our illness with the bailout. This is masterful.

 

But the bailout is also about job creation (whose?), reducing taxes (really?), reigning in spending (all $700 billion worth?), and trade (this is part of her comedy routine apparently). And then in the spirit of Halloween which is just around the corner, she says trade should be seen as an opportunity, not just as a scary thing. Brilliant. But she forgot to mention Christmas and being a maverick cleaning up Washington. Rats.

This isn’t just comedy or entertainment. This is politics at it’s most lucid. Or is that ludicrous?

California Election and Civil Rights Attorney Discusses Republican 2008 Presidential Election Tactics, Robo Calls and Negative Ads

I am deeply concerned, not just as a Civil Rights advocate, and not just as as a constitutional and first amendment lawyer and as an election attorney in California, but simply as an American at the election campaign tactics I am seeing in this 2008 Presidential election by the Republican party. Even as criticism mounts from both Democrats and Republicans, the tactics being employed by the Republican Presidential candidates are destroying any semblance of truth and fairness in the election process and using discrimination to try to gain votes.

Now we are hearing of the latest tactic by John McCain, the very candidate who previously criticized this tactic in a previous election – robo calls. Robo calls are automated telephone calls that are negative attacks on the other candidate, only instead of airing these ads on television, they come by way of the telephone, usually when you are having dinner.

John McCain only days before he began using these robo calls, criticized the Democratic candidate for allegedly spending more money than any campaign in history on negative ads. Whether this claim is true or not in terms of money, it does not appear to be true in its inference that Obama is using a greater percentage of his ads on negative ads. That would be John McCain’s campaign.

In his latest tactic, John McCain has clearly crossed the line once again by using these automated calls to tell voters that Barack Obama allegedly voted against a bill that would give care to babies born alive after abortions, that Democrats will enact an extreme leftist agenda if they take control of Washington, that Obama places Hollywood above America, that he has worked closely with a terrorist, and that Obama lacks the judgment to lead the country.

Now add the inferences by the Republican party and/or their candidates, surrogates and the people introducing the candidates at rallies that the Democratic candidate is unpatriotic, has an arab sounding middle name, is a person to be scared of, or is a person who can’t be trusted, who has a hidden agenda, or who by virtue of an association with someone who did something when the candidate was eight years old, is a terrorist. Is it any wonder that a woman, at a rally like so many others for the Republicans where hate-filled shouts have been made in recent days, told John McCain she had read that Barack Obama was an Arab?

How, after all these years of improving race relations in this country, are these tactics and election advertisements being allowed to cause civil rights leaders and members of the public fear they are taking us back to times in this country that we thought were behind us? How can a candidate who claims he puts his country first make every attempt to divide this country? We all know that John McCain, who has a long and honorable past, is a better man than what we are seeing at his rallies or on one particular news station. Yet, we continue to see actions and comments at Republican rallies and now these robo calls that have now drawn the ire not just of civil rights activists but even the concern of other Republican Congressmen and Senators. Is it any wonder that Colin Powell, a Republican who served as Secretary of State, Chairman of the Joint Chiefs of Staff and National Security Adviser under Republican Administrations has come out in support of Barack Obama and criticized the campaign tactics of John McCain, the latest of which is to infer that Obama’s policies are socialist.

In the last several elections, the focus of many of the most objectionable tactics were to pit religious voters against voters for whom religion was not an issue, based on perceived stances by one or the other candidate on religious issues. This type of insinuation has also been used this year against the democratic candidate, on the basis of an incorrect assumption by some and an intentional mischaracterization by others that since Obama was born in Kenya, he must be a Muslim.

More anger and consternation was brought to the surface this year with the strong showing by Hillary Clinton in the primaries and the selection of Sarah Palin as the vice presidential running mate of John McCain. With questions raised in particular toward Sarah Palin of whether she could be vice president and still be a good mother, women cried gender discrimination foul at the media.

Is it naive to ask why a candidate’s religion ever enter into the debate? If the candidate says he won’t let it interfere with his being fair and evenhanded, shouldn’t that be the end of it? Why should a candidate’s age be a problem if they are knowledgeable and not in bad health, if the Vice Presidential candidate is qualified as well? Why should a person’s gender ever be a problem? But to many voters, these aspects of a candidate are the most if not the only reason for how they will vote.

Perhaps we, as a nation, are forced to accept that at election time, some of people’s worst sides rise to the forefront in our election process, but shouldn’t we be better than that, and shouldn’t the persons we are asked to elect be better than that?

If the polls are any indication, this year we may just see a backlash against those who would make discriminatory inferences, and whose party would use false allegations as the basis for part of their campaigns. It may be naive, but it is hoped that based on a few comments made in the last few days by John McCain, before the election is over and with signs he is behind in the polls, John McCain will repudiate the statements made out of anger and fear by supporters at his rallies even more forcefully than in some earlier statements and again repeat that his supporters should be respectful of Barack Obama and his accomplishments. For at this time in our country’s history, our country can least afford to be torn apart by campaign strategies that have little to do with solving our country’s economic crisis.

San Diego California Publishing Attorney Talks About Publishing, Elections, the Media, and Constitutional Law

No matter where you live, whether it is in San Diego, Orange County, Los Angeles, La Jolla, Del Mar, Pacific Beach, Carlsbad, Oceanside, San Marcos, Mission Beach and Escondido or the cities of Huntington Beach, Anaheim Hills, Yorba Linda, Buena Park, Anaheim, Santa Ana, Irvine, Costa Mesa, Irvine, Newport Beach, Corona del Mar, Laguna Beach, and Laguna Hills, Buena Park, Temecula, Indian Wells, La Quinta, or Palm Springs, unless you haven’t turned on the television or read a newspaper during the 2008 Presidential election, or looked at the internet, you have seen claims by the Republican campaign that the publishing media is biased.

Attacking the media has long been a tactic of national candidates. In this election, once again, we have seen this tactic employed, yet with little of the success it enjoyed in previous Presidential campaigns.  As an election and  constituitonal lawyer, one can only applaud this lack of success in the use of this tactic in this election.

For the most part in this Presidential campaign, one candidate has been leveling these attacks on the press with regularity and with increasing anger, John McCain. While newspapers expect this to some extent, the public that is not wedded to one side of the fence or the other appears to be tiring of the attacks.

Recently, John McCain denounced the New York times in the strongest words, following a Times report that McCain’s campaign manager, Rick Davis, had been pain nearly $2 million by mortgage entities Fannie Mae and Freddie Mac. McCain’s chief strategist, Steve Schmidt said the New York Times is no longer a journalistic organization but is 150 percent in the tank for Barack Obama. Schmidt earlier attacked MSNBC as being an organ of the Democratic National Committee, and said the news media are on a mission to destroy Sarah Palin.

Unfortunately for John McCain, it has since been reported in the press that McCain’s campaign manager’s lobbying firm owned by his campaign manager has received $15,000/month for nearly three years and that and that the campaign manager was paid $30,000/month for nearly five years by an advocacy organization that he headed and which was financed by Fannie Mae and Freddie Mac to fight regulation. It has further been reported that McCain’s senior advisor, his campaign’s vice chairman, and his Congressional liaison, also made large sums of money from Fannie and Freddie lobbying or were in firms that did.

In an apparent attempt to deflect attention away from his mistaken attack on the New York Times story, McCain then announced he was suspending his campaign to immediately fly to Washington after awaking that morning to find a report in the Washington Post that he was behind in the polls by nine points. Soon after attempting to criticize that finding, and knowing what the disaster Sarah Palin’s interview with Katie Couric would be aired that night, McCain chose to dump his appearance on the David Letterman show, upstage the Couric interview with his own interview on the CBS News, and announce the suspension of his campaign that was in reality, never a suspension.

In hindsight of course, McCain’s actions were a huge error in judgment. His dilly-dallying around New York after ditching Letterman were picked up on and hammered at him unmercifully for two nights on the David Letterman show and later on the Daily Show, other news shows, on the internet and in the press. By the time he arrived the next day in Washington, it had already been announced that there was bipartisan support for the bailout bill, that just as quickly dissipated upon his arrival. It was reported that his campaign had not been suspended and Letterman, among others joked at his expense why he must have felt he could not leave his campaign in the hands of Sarah Palin, when she was seen incapable of answering simple questions put to her by Katie Couric. And after announcing he would not take part in the debate until there was either a bailout bill or great progress toward one, he had to fly back from Washington for the debate with no bailout bill in hand and Congress much less united than when he had arrived.

In the past, attacking the press has proved fruitful for Presidential candidates. This time the attack is falling on deaf ears and has either been the exception to the rule that it will help a candidate, or there is a change taking place in what a candidate risks if he is wrong.  As an election, campaign, publishing, marketing, media and constitutional law attorney, one can only conclude that negative attacks by the candidates are not working as they used to, whether it is against the media or against the other candidate.  The public has become weary of such tactics and it is showing in the polls.
