A General Overview of a Lemon Law Claim

All states have automobile based lemon laws to protect individuals who have purchased defective motor vehicles. In addition, there is a Federal Lemon Law known as theMagnusson Moss Act which provides some protections to you. While the law is different in each state, many similarities can be found in the state lemon laws and the Federal Magnusson Moss Act. Typically, your auto must exhibit a defect or non-conformity that substantially impairs the use, value or safety of your vehicle. Examples of this might be engine, transmission, braking, suspension or other serious problems. The defect must first occur within some defined mileage parameter, usually 12,000 or 18,000 miles or the first year that the car is in service. The lemon laws always provide that the consumer must give the manufacturer a reasonable number of attempts to repair the problem, and the number that is considered reasonable can vary from state to state.

The number of repair attempts is usually three or four, but check your state law to be sure. If the manufacturer cannot repair your substantial defect within that number of attempts, then you have a lemon. Most states set forth that you are entitled to a refund of the purchase price or a replacement vehicle, free of charge. These laws usually provide for the recovery of all consequential damages that you may have encountered as well, such as all of the payments that you have made on the vehicle, including interest, any down payment, any repair charges, etc… The lemon laws are very much geared towards protecting the purchaser of a defective vehicle. They are extremely friendly consumer statutes.

The problem is that having a lemon and getting a manufacturer to agree that you have a lemon are two very different things. After your vehicle has been in for repairs the requisite number of times, the first step that you have to take is to advise the manufacturer, in writing, of your concerns. This usually takes the form of a letter to that manufacturer that revokes your acceptance of the vehicle. What that means is that you are attempting to rescind the contract between you and the manufacturer for the sale of the vehicle, and are making a demand for a refund or a replacement vehicle. The manufacturer will rarely agree to your demand at this point in time. The next step, which is mandated by many state lemon laws, is that you have to submit your claim to an Arbitration panel for review. Many states, and many manufacturers, use the Better Business Bureau as its Arbitration panel. These Arbitration panels are usually non-binding on you, the consumer, but are binding upon the manufacturer. In that regard, it has been my experience that the Arbitrators tend to lean towards the side of the manufacturers in these types of cases, because they know that you can go further, and the manufacturer cannot. Be very careful with the Arbitration process.  If your state does not require you to go through the process, you are often better off just filing a lawsuit.  After Arbitration, if the award is not in your favor, or to your liking, the next step in your lemon law claim would be to file a lawsuit against the Manufacturer in a court of competent jurisdiction. It is at this point that the Manufacturer realizes that you are serious and may begin to entertain realistic formal discussions regarding your vehicle’s problems.

This may sound like a lot of work, a lot of hoops to jump through, and it really is, but the great thing about lemon laws is that they typically provide the consumer with Free legal representation. That’s right, you can get an Attorney to work for you for free! The Attorney is not actually working for free, but the lemon laws usually provide that the manufacturer must pay your reasonable Attorney fees if the vehicle is found to be a lemon. Lemon Law Attorneys rarely charge any up front retainers, and may or may not charge you for out-of-pocket costs on such a claim. These Attorneys typically look to the manufacturer for their fees and reimbursement of costs. While I would not wish a lemon upon anyone, getting a free attorney to assist you is not half bad.

What Is A Lemon Law?

Lemon laws are United States Laws designed to protect the rights of consumers. They are usually used for vehicles but apply to all commercial articles. In this article we will concentrate on Lemon Laws as applicable to vehicles. A lemon is a term used to describe a new vehicle that needs excessive repair even though it is new. It has to meet the following criteria:

Age. Usually for vehicles less than a year old.

Warranty. Usually within the warranty period. In some states the warranty period is not recognized and the cases may be entertained even if the vehicle is out of warranty period depending upon the discretion of the court. The rights of consumers by virtue of Lemon laws may exceed the warranties given by the manufacturer.

Repairs. The vehicle needs frequent identical repair, usually at least 4 times. The repairs should be major repairs that affect the operation, safety and value of the vehicle.

Down Time of the Vehicle. If the vehicle is down for more than 30 days in a year due to defect then it comes under the ambit of lemon laws. The 30 days need not be consecutive days.

The lemon laws cover only new vehicles and not used vehicles. The vehicle owners should note few points that help in proving the case in court.

Repair Order. A repair order should be obtained for every repair visit. The repair order should detail date, problem or diagnosis and attempted repair on the vehicle.

Purchase documents. Purchase documents like contracts, warranties, bills etc should be preserved.

Lemon Law Notice. A lemon law notice should be served to the manufacturer for a refund or a replacement vehicle. The manufacturer should respond within 30 days. For normal wear and tear in the lemon vehicle there should be no deduction from the manufacturer.
Manufacturers Arbitration Program. Some states make it mandatory to use the manufacturers arbitration program if available before suing them in court.

Attorney. Utilize the services of an attorney as they are aware of the details of the laws. Many lawyers work on contingency basis, which means that you pay the lawyer if you win the case. Usually the courts award double the cost of the vehicle plus the cost of litigation if you win. Most such litigations are settled outside the court, so it is wise to hire a competent lawyer who can negotiate to your benefit.
As with most laws, Lemon laws vary from state to state, however the principle remains the same, which is protection of the consumers interest.

The 10 Most Common Mistakes That Daughters-in-Laws Make

Having a good relationship with your husband’s mother is hard! It takes work, I know! But if you put in the time, you may come to truly appreciate your mother-in-law. Her softer, kinder side may emerge and you may even avoid the repeat daughter-in-law zings that we all experience from time to time (some of us more than others!)
Mistake #1 — Forget to Call Your Mother-in-Law Regularly– You’ll be amazed how much she appreciates it when you keep in touch with her, and not just when your husband calls! Strive to have an independent relationship and call her at least once a week. You can keep it short or aim for when she’s at Bingo and leave a message on her machine!
Mistake #2 — Forget to Frequently Ask Your Mother-in-Law How She’s Feeling– You must do this every time you see or speak to her. As an added touch, offer to accompany her on doctors visits whenever possible. She’ll appreciate that you took the time to care.
Mistake #3 — Don’t Compliment Her Often Enough– Always make her feel good around you. Tell her how pretty, thin, healthy, and young she looks. Say what flattering outfits she’s wearing, occasionally asking if you can borrow a certain item of clothing or a purse. Mention that you love her hairstyle, even if she’s wearing a hairpiece (especially if she’s wearing a hairpiece!)
Mistake #4 — Forget Your Mother-in-Law’s Special Days– Your husband will likely forget, so you’ll have to be the one to make sure this gets done, without fail! For her birthday, Mother’s Day and other important holidays, pick out a Hallmark card with the most heart-wrenching sentiments you can find. Make sure your husband signs it too. Better yet, have him write the note from the both of you.
Mistake #5 — Get Defensive with Your Mother-in-Law– This is the easiest mistake to make, but do yourself a favor and practice not taking things personally. If you find yourself getting defensive with your mother-in-law take a deep breath – then another – and make a casual, self-effacing comment – then make some chamomile tea. Be sure to offer your mother-in-law a cup as well –and make sure you have her favorite tea bags on hand at all times.
Mistake #6 — Don’t be Objective When Your Mother-in-Law Criticizes You–If your mother-in-law tells you your hair looks better the other way, enthusiastically thank her by solidly agreeing how difficult it is to be objective about yourself. Then style it that way while she’s visiting. Of course you can change it back when she leaves, although be open to the possibility that she may actually have a point!!!
Mistake #7 — Ask Your Mother-in-Law for Professional Advice– This is a real no-no, because if you try to get her approval, YOU WON’T! If you do try to get her endorsement for the new Pampered Chef Opportunity you’ve been thinking about and she downplays your enthusiasm, simply say, “Wow, you are so right. I’m not going to give this crazy scheme another thought!” Then, buy all her birthday and Christmas gifts with the 40% discount you get from the new business.
Mistake #8 — Expect Your Mother-in-Law to Share Your Interests– Your mother-in-law won’t appreciate the movies, music, books or TV shows you enjoy. While at your home she may even decree, “How can you watch that? It’s so silly.” Instead of defending your entertainment choices, simply respond with something to the effect of, “That is just SO true! Then fluff up your pillow and hide the remote until she leaves.
Mistake #9 — Don’t Save Gifts from Your Mother-in-Law For At Least a Year– When your mother-in-law gives you a gift, make sure you display it prominently in your home, or wear it a lot when she’s around. If it’s not your cup of tea, don’t get rid of it prematurely. There is nothing more humiliating than not being able to produce whatever it may be upon inquiry due to over-hasty re-gifting!
Mistake #10 — Pick out Presents for your Mother-in-Law– The best way to handle gift giving is to let your husband do the buying. Even if the responsibility of holiday shopping usually ends up on your shoulders, give him the assignment of this one single thing–it’ll be worth your while to make sure he follows through!

In The World of Entertainment – Where Do Children Go?

In today’s society we know that the moral fiber of our communities is in peril. Why then, do we not protect our children? We have a responsibility to safeguard our most vulnerable; instead, we prematurely catapult them into a world they are not mature enough to handle and destroy their innocence.

Frequently, I am asked by parents and friends of aspiring “stars” to offer my opinion about getting their child into show business. Recently my publicist, Marsha Friedman, President of Event Management sent me the following question:

“…After the performance I spoke with her mom (who was in tears the whole time) about their incredible daughter and her future. Their daughter’s dream is to be on stage singing professionally…I said I would forward some information to you – to get your thoughts.”

After much contemplation, I wrote to the parents (excerpt):

“No matter how strong your daughter or your dream is, wait until she is 18 to try for stardom. She is already doing what she most wants, and that is to be on stage. Once she is 18 and you are ready for her to sell sex to other teenagers and older men in their 20’s – 60’s, she will be better equipped to handle the response, as you will be also…”

These words may strike you as unnecessarily candid, and perhaps a touch vulgar, but the reality is that most parents and children do NOT dream of just “being on stage.” If that was the sole requirement for their happiness, then local stage performances (a much safer avenue) would satisfy their dream. Since the child may already be doing that, there would be no more questions as the goal would have been achieved. Sadly, the aim as stated is wrong. What the parents and child really want is stardom, without knowing the cost.

They focus on the Hollywood dream and convince themselves that the path to stardom will be a romantic ride. The fantasy is filled with adoring fans, endless wealth, eternal fame and glamorous travel. This illusion inevitably fades, and what remains is disappointment, heartache, bills and endless travel (in less than desirable circumstances). More ominously, some of the “adoring fans” may actually be obsessed with the child, to the point of danger. This should not be entirely surprising as the child is being sold to look like the American male fantasy of an adult woman.

Many people reading this article will be convinced that I am wrong, or at least exaggerating. I ask you to consider the last time you saw a child “star” that looked like a child in their videos? The typical images are a 15 year old Britney Spears, a 14 year old JoJo, or a 13 year old Leanne Rimes

When Spears came into the public eye, she was dressed like a Catholic school girl, seducing the audience with, “Ooh, baby baby.” Leanne Rimes was dressed in a black satin outfit singing, “How Do I Live Without You.” (It should be noted that her ‘look’ would be considered tame by today’s standards.) Why are they dressed this way? Frankly, the music industry sells sex, sex sells.

These girls (although Leanne and Britney are now adults) are talented and beautiful, yet they are strategically packaged to entice older men. The fans who are young teenage girls don’t care whether the artists are sexy when they purchase music. However, continually seeing their idols dressed seductively has made them aware of sexuality and they want to dress the same way. This contributes to the cheapening of children’s values and image, and the cycle continues.

Recently, I was running on the treadmill at the gym when I was stunned by what I saw on one of the news channels. It was a feature about a modeling contest for children limited to those twelve and under. The winner would receive a one million dollar modeling contract, which of course sounds amazing! However, as the clip continued, mouths dropped throughout the gym. Three girls (under 12 – contest requirements) dressed in skimpy bikinis were being drenched with water and gazing at the camera like they wanted to seduce each man watching. If the girls were twenty-five, aware of what they were doing and, as adults, making their own decisions, I wouldn’t think much about it. However, the participation of twelve year olds is horrifying. Child pornography is universally condemned and pedophiles treated with not only revulsion, but the full force of the law. Doesn’t this fall under the same category, just corporately condoned?

In my opinion, prostituting children in this manner is perpetuating child pornography in a purportedly “legal” manner. This practice needs to be stopped. While the music industry to date, has not participated in such an extreme level of exploitation of children, I still believe that children should be kept out of the music industry on a professional level until they are at least 18. Even with the strongest family support possible, they are not emotionally equipped to handle the issues that will inevitably emerge. Realistically, however, I know that children will continue to be signed and sold long before their eighteenth birthdays, let me offer some practical advice.

1. From a financial perspective, learn the business inside and out. You MUST know: Who gets what and why? How much was made or lost? What is the bottom line? If you don’t make this a priority, you will join the host of famous artists who have been forced to claim bankruptcy.

2. Put together a dazzling press kit. People receiving the kit must be enticed into opening the package, so you will have to present your child in their best light. The demo must be well produced and include four of your child’s best numbers. Keep in mind that each song will be listened to for about fifteen to thirty seconds before moving on to the next piece. It’s possible to make a pretty impressive demo on your own for about two thousand dollars, including pressing. Don’t fall victim to the scam of someone guaranteeing stardom for your child with a professionally cut demo if you simply write a ten thousand dollar check.

3. If possible, establish a track record of sales BEFORE any contact with recording labels. (Get your CD listed on Soundscan.) You’ll have greater bargaining power if you know your product value prior to negotiating.

4. If a label finances the recording of a CD, it is a loan, NOT a gift, and must be paid back. The recording industry is a business, not a charity. Beware of becoming competitors insurance. If you fall into that trap, you may lose everything. (I detail all of this in my book, The Indie Guide to Music, Marketing and Money.)

5. The phrase is, accurately, “Show Business,” and your child must be prepared to put on a “show,” just as you and they need to learn the “business.” Britney Spears, Christina Aguilera, Madonna and Justin Timberlake are great examples of how this is done and the work involved to sustain sell-out crowds.

6. Provide acting, vocal and dance lessons for your child, and register them for writing classes. Writers currently receive 8.5 cents per song on a CD, while the artist generally receives one point per album. Writers make the most money, with little or no initial investment. Make sure you understand how to legitimately copyright music. The aptly named ‘poor man’s copyright’ won’t hold up in court.

7. Avoid anyone stating that for an upfront fee, they can make your child a star. Managers and agents get paid a percentage in the range of 10-20%. Managers usually receive 10-15%, while agents receive 15-20%. You also need to know and understand the difference between managers and agents. Similarly, lawyers shopping a deal for your child on his/her own volition will take a percentage of the contract. (Lawyers that you hire on your own request must be paid up front.)

8. Marketing and promotion are imperative and can be very expensive. Labels have access to promotion capabilities that most individuals cannot afford. However, there is no limit or cost to imagination, so be creative! Affordable promotion can be attainable.

9. Develop personal relationships with contacts at the labels. Once you get to know people, they may offer you a special code to put on the outside of your package which signals to the front desk that your package is requested. (simply writing “material requested” on the outside of the package will not work) DON’T submit anything without permission; most throw unsolicited press kits in the garbage and a few return them unopened. Warner Brothers sends a nice note referencing legal concerns, while Disney sends a nicer more detailed note explaining their policy around copyright laws. Don’t waste valuable product and time.

Currently, many people are considering the ‘American Idol’ route, while forgetting that only one person in the 22 million that showed up for auditions last year actually made it.

Laws of Success

Just as there are physical laws that govern how the physical world works, gravity, for example, there are also laws that govern how the universe works. Understanding these laws is critical to achieving success, learn them and work with them, not against them.

1. The Law of Perpetual Transmutation

Basically, this law states that what starts as energy changes into what is physical. Everything around you, everything you see, hear, smell, touch, or taste began as energy.

The vibration of that energy forms what is physical. Everything is in constant motion, and that motion is always changing. Energy can not be created or destroyed, just moved and changed. Our thoughts make themselves manifest in the physical world. In other words, what we think about, we bring about.

2. The Law of Relativity

The way we perceive any object, thing, person, or idea is always relative to how we see another object, thing, person, or idea. It’s the way we gauge what we see, bigger, smaller, good, bad, better, worse. The whole universe is designed to work together, with all the laws corresponding rather than conflicting.

All the laws apply equally to everything in the universe regardless of their size, strength, or awareness of the laws. Everything in the universe has its own rate of vibration, high, low, and in-between, we can only evaluate the rate of vibration based on a comparison with the rates of other things.

In your life, you see this law played out as you compare yourself to other people. You are reasonably attractive, right? Now, say someone enters the room who has entirely unfortunate looks, you feel simply gorgeous in comparison. But what if a supermodel enters the room next? How good-looking are you then? It’s all relative. The core of this law is that everything in life just “is”, our perception shapes how we experience it.

3. The Law of Vibration

This law says that nothing is at rest in the universe, it’s all constantly vibrating. Our awareness of that vibration is what we call feeling. Our feelings are determined by vibration, and we determine our rate of vibration by our thoughts and the paradigms we use to look at life.

You’ve experienced this if you’ve ever walked into an office or house where people were just quarreling. The tension in the air is thick enough to cut with a knife, and you instantly know you’ve interrupted something unpleasant.

Our thoughts consist of vibrations we send out to the universe. When we focus or concentrate on our thoughts, the vibrations grow stronger. Thoughts are the strongest vibration to move through the universe.

God created the whole universe, all that there is, seen and invisible from nothing, using thoughts and words. People are the only creation who share the power of thought with the Creator, and that makes us special.

This power to think, this gift of spirit, is what it means to be created in the image of God. Our thoughts and prayers are very powerful, affecting the physical world we live in.

Our awareness of vibration is what we call our feelings. We see what it’s like to be in a negative vibration when we say, “I feel bad today.” A positive vibration shows when we say, “I feel great today!”

Since vibration originates with our thoughts, we can control whether we live in a positive or negative vibration pattern. You use your brain to choose which thoughts you’ll entertain, it doesn’t choose a vibration itself. You’re the master of your thoughts, of your vibration. Your thoughts steer your central nervous system into the vibration you choose.

Your mind is a storehouse of images, positive and negative, whatever you allow to take up room there. If you choose to dredge up, examine, and review the negative, you will move into a negative vibration, negative feelings will immediately follow. The reverse is true, positive thoughts lead to positive vibration and a positive mood.

4. The Law of Polarity

Everything has an equal opposite, up and down, good and bad, empty and full. There is no such thing as a one-sided coin. No object has only a left side without a right side.

Because everything not only has an opposite, but the opposite is also equal, we’ve got an immutable law that we can understand. If you measure the room and find it is eighteen feet from the wall to the door, you’ll find it’s also eighteen feet from the door to the wall.

Seems pretty obvious, but the understanding of this law will really change how you look at life. Say something you think is really bad happens to you, according to the Law of Polarity, there must be something equally good about it, too. Mathematically, if something happens to you that you see as only being a little bit bad, the flipside is that there’s also a little bit of good in that, too.

Because of the Law of Polarity, you also get to choose your thoughts on every occurrence in life, is this a good thing or a bad thing? In reality, it just is. But you have the privilege of interpretation, you can choose to view it as a positive or a negative. From that choice, you set vibration in motion, determine your feelings, and ultimately your actions and results.

5. The Law of Rhythm

The whole universe moves in a repetitive rhythm. The tides, the seasons, day and night, we can count on these regular patterns to stay constant. If anything moves forward, something else must move backward; if anything grows greater, something else shrinks.

Every action causes a reaction, and results in a rhythmic swinging of vibration. You see this law at work every day in the peak and decline of your energy, the ups and downs that you experience, the way that our days are sometimes full and busy and sometimes slow and lazy.

It’s helpful to realize that our moods have a natural rhythm of ups and downs, and that even in the midst of a relatively down mood, we’ve still got control of our thoughts. Choosing good thoughts, even when we feel down, propels us into a positive vibration, evening out our emotions and keeping us moving toward our goals.

6. The Law of Cause and Effect

This law states that for every action, there is an equal and opposite reaction. What you send out into the universe comes back. Luck, chance, and accidents are non-existent. Everything in the universe is subject to universal laws, and everything that happens does so because it was caused.

We see the result of this law in the physical world, in our health, our bank accounts, and how people treat us. The way we get results we want is by working on the cause behind them. A changed cause must produce a changed effect.

One way to change your cause is to focus on it, using positive affirmations to point you in the direction you wish to go. In each area of your life, develop positive statements you can repeat in your mind regularly. These affirmations should be in the present tense, carefully crafted to focus you on what you really want.

7. The Law of Gender

This law describes how every seed has a gestation period. We see it in nature all the time, you plant carrot seeds, and can expect to wait about seventy days before the carrot is ready to eat. If you conceive a child, it takes about forty weeks for the baby to be born.

The same is true for ideas. They are spiritual seeds, and take time to become manifest. You must be patient when you plant a spiritual seed, an idea. It will show itself in physical form when the time is right.

Every idea that is given energy moves into the physical world. Everything in the universe has a masculine and feminine side. We see it in every person and animal, and even in the plant world.

The principle of both male and female in all things makes potential, regeneration, and motion possible. Both male and female are required for life to exist. This law demonstrates how everything comes about, how things change from what they were into what they become.

You may be familiar with some of these concepts, the structure and function of your mind, and the universal laws of the universe. Some may be completely new to you.

Understanding them is so important in the process of achieving your dreams, of living the purpose-filled life you were designed to live, of living in a way that is fulfilling and proactive.

If you’re serious about making changes, about winning in life, about living up to your potential and helping everyone around you to do the same, you’ll commit yourself to learning these Laws of Success.

Reflect on them, discuss them, and do all you can to comprehend them, teach them to others, too. The more aware you are about how it all works together, the more you can put these ideas and laws to work for you so that you’ll experience more success and less frustration.

Entertainment Agencies – The Way To Avoid A Ruined Event

Sounds like the title of a spaghetti western, and to be honest, it probably over the years has had as many casualties. So what am I talking about? The answer is bad entertainment.
I think most of us can relate to either a personal experience or the experience of a friend, to how the focal point of an event ruined it. The entertainment at an event is probably the most crucial part, if you don’t include inviting the guests, and when it goes wrong everyone notices. Just the other day I was in a conversation and was told about how a DJ failed to turn up at an event, that event being a wedding, and how despite repeated phone calls no one could contact the party involved. This basically ruined what should have been the best day of two peoples lives, a real shame as everything else had gone so smoothly. This is something not just confined to private events, it can also effect corporate ones too. Imagine planning a corporate event, your colleagues will be there, perhaps someone high up within the company is flying in from abroad, or you are trying to make a good impression on future clients and seal a deal worth a lot of money. Everything is in place, or so you think, then out of the blue….. nothing, no entertainment. Panic sets in, but in the end there is little you can do, it is too late. Of course the entertainment can arrive, but still let you down. A band in jeans and T shirts at a black tie corporate event, the wrong music, there are so many aspects that to list them all would become boring for those of you reading this.
So what is the solution you ask? The best solution is to use an entertainment agency. Allow me to explain. At one time all UK entertainment agencies had to be licensed, which is no longer the case, however all entertainment agencies are required to comply with the employment agencies act and it’s amendments. This gives you, the client, legal recourse, which you can exercise if, need be. Some entertainment agencies are members of professional bodies such as The Agents Association or the NEAC (National Entertainment Agents Council), if they are then these should be your first point of contact if you have a problem, which you cannot resolve. Both organisations have a code of conduct for members and also have a disciplinary process available. If an agency is not a member of either, and the complaint is serious enough, then you can make a complaint to the DBERR, formally the DTI, who have powers to act against and impose severe sanctions on rogue agencies.
I am sure there are people reading this who are saying to themselves, is this just a plug to get business, the answer is no. Although I run an entertainment agency, I am not saying that everyone should use our services, people should and do have a choice. I am saying make sure you use a reputable entertainment agency, of which there are many. So what can you expect from a reputable entertainment agency, the first is a high level of service, professional people to source entertainment to your needs. The second, if something goes wrong, a reputable agency will do its best to put it right. Third, legally binding contracts between the parties involved.
Now I am sure there are some people saying, I have a contract for my DJ/Band, he/they sent me one, or I always use an agency and have a contract. My question to those people is “IS IT LEGAL”? Just because you have a contract doesn’t mean that it is legal or that in a dispute it will hold up in court. Always make sure that any contract you have complies with the law. If in doubt always ask the person issuing it, or take independent legal advice. The good news is that a legal contract is everybody’s safeguard, and it will detail all the requirements, so you can rest easy knowing that everything is covered.
So in conclusion, to make your event memorable for all the right reasons:
Always use a reputable agency, to avoid the bad or the indifferent, and just enjoy the good.

Pets Make the In-laws Tolerable

Have you ever noticed how a pet, can ease life’s tensions? We all are faced with stress and anxiety beyond our control sometimes. Take for example a simple visit to the in-laws. (If there is such a thing.) None of us like it. There is usually some family dispute that needs to be settled. Or in some cases such a mismatch in personalities that there is nothing to talk about. However, the whole ordeal can be made easy just by bringing your pet along.

First off, you won’t feel alone. There is no greater feeling than knowing you have your best friend with you. When the arguments start flying at least your dog will be on your side. Having your pet with you can make all the difference in the world.

When you are faced with that awkward moment of silence, your dog makes a great distraction. You can start to talk about your dog’s latest adventure and hope to get a smile or even a chuckle. Let the dog break the ice. Then some of the other fun benefits of having your best friend with you are entertainment. If you’ve got a dog that is ready for action, a few chew toys, and a crowd of relatives, you could keep everyone entertained for hours. In my case I don’t even need the chew toys. All I have to do is remind my dog that he hasn’t caught his tail yet, and then round and round he goes. Also, in some rare cases your in-laws may grow attached to your dog. Which in my case makes me very proud.

Then when it comes time for a sleep over situation you can rest at ease, because your dog is still in your care. How many times do we leave our pets with someone or take them to the kennel only to spend the whole time we’re away worrying.

It can be very difficult to leave a friend behind so if given the opportunity, bring them along. You’ll be able to get a good night sleep. You’ll have a lot of fun. You’ll have great topics for conversation. And, you’ll even be able to tolerate the in-laws. Well … I make no promises. Actual results may vary.

The Holocaust and Law of Attraction

This topic is used by people who don’t believe in Law of Attraction to try to prove their case. They say “if Law of Attraction is real, did 6,000,000 Jews attract their own death in the holocaust?”

It sounds like a great argument. All LOA gurus don’t like to deal with this argument. Even my own favorite author who is a recognized leader in the LOA movement has responded to this question at her seminars by saying to the questioner who asked about the Holocaust…”why do you choose to ask questions about such negative scenarios which in turn, keeps you focused on resistance in relation to your vibration?”. Now I am paraphrasing what she said but I have definitely caught the flavor of her response and IT IS NOT AN ANSWER.

So where to start to give even a glimpse of a proper answer. I must lay some foundational ground rule assumptions. This all can be looked at as no more than my opinion. I ‘am not saying that this some written in stone answer. It can also be looked at as perspectives of “being’. However, I assure you it is not contrived.

Do adversaries of LOA believe that a human being is just a higher animal form destined to die into nothingness? Do they believe that the “being” that is human has any special powers or is omniscient and omnipotent? In order to understand my explanation, one would have to first believe in this foundational assumption… that “beings” who are human ARE endowed with powers that are omniscient and omnipotent. That foundational belief can be quite a stretch for those who argue against LOA.

O.K. so now, assuming, we have a very “Godlike” being existing in a physical body. We of course must assume that the “being” has NO LIMITATIONS while the physical body IS LIMITED to physical laws.

More questions…Do you believe that you, as a human “being”, can manifest any circumstances at all in your own life? Elsewhere, your life has been represented as your “canvas”. How others view your life is what they are seeing and surmising from the canvas that you have created and are demonstrating.

Now we must entertain areas that become even more questionable to many and those are areas such as mass manifestations, the mass mind, the sub conscious, the super conscious and the choices to which any “being” has access. The choices a being has, are infinite. A human “being” is by no means a simple creature.

A person’s life can be looked at as that individuals “demonstration” or as stated …his or her canvas. The final stroke upon that canvas is the individuals type of departure or “death OF the physical”. There is no death for the “being”.

We have expressions like “the good die young” to quell our sadness when we see young people die in a car accident or in battle or die in some atrocious way. We question the meaning of seemingly senseless deaths, senseless murders, senseless illnesses, senseless disabilities or deformities that babies carry at birth. It is all not senseless. These ARE demonstrations. Could “beings” choose these horrific demonstrations you ask?

Some believe these conditions are inflicted upon the individuals by fate, luck, destiny or God. To believe that is to believe that your life is controlled by outside forces. To understand my answer to this question you would have to believe in manifestation, mass manifestation, freewill, and the omnipotent power of a “being” that is human. You would need an understanding of the subconscious, super conscious, and the mystical magic of this powerful being’s choices of demonstration.

Again this sounds like quite a stretch for the average “human being”. Can your imagination make these “stretches?” The opinion of one’s own self can be high or low or anywhere in between. I, simply, choose …extremely high.

For some individual being to make the choice that his personal demonstration will contain such horrific or atrocious “qualities” is unfathomable for most people. They “believe” that no individual being would choose such a seemingly ugly demonstration of life and death.

Let’s face it, most people don’t believe we choose our type of death or control the time of our death because they do not understand the “being”. They have no connection with their super consciousness and they look at life from quite different perspectives than those that are mentioned here.

Even if you are going along with me purely for the sake of your momentary entertainment, I realize your mind may be spinning and flooded with questions and counter arguments. You might ask and state simultaneously, “this is absurd, no one would choose such horrible demonstrations even if they could”. My response to that is…Who are you to say what the perspectives of an individual omnipotent being would be and what reasons that being might have for making choices that you as a “human” can not fathom. Now we are coming to the point.

There is a difference between the physical human and the all knowing “being”. That understanding can take humans many lifetimes of physical experience to achieve. That understanding is contained by the “being” before and after its physical birth and death. It is an awareness quest that the “human” embarks upon. It has been called enlightenment.

As humans, many of us see death as a tumultuous event. As beings we see death as no big deal. As beings we see death as being no more tumultuous than going to sleep at night and waking up in the morning. To the being it is not only some simple, matter of fact, transition, but it is a welcome transition because the being knows that it returns to what has been called source or the non physical. That place is adored by the being and feared by the human. I am speaking of most humans and all beings.

So now, with all this foundational belief information….I say these mass manifestations in situations like the Holocaust do not put the “victims” at fault. Other evil players, like Hitler, certainly played their part in creating and bringing these events to fruition. Some people with a distorted view of karmic retribution might say that the evil players will reincarnate for eternal lifetimes as a fly in stool. I am not going to get into explanations of karmic lifetimes but I will say that justice does prevail especially in the alternate realms. That justice has been described elsewhere as self inflicted…the most appropriate of all justice.

To the beings who participated, their choices were holy, dignified and superior choices. They are, many times, the choices that only the greatest beings and spirits could make and they often appear as victimization.

These demonstrations are a way of going to war against atrocity and teaching by example for generations to come. These demonstrations expose the perpetrators and defeat them in a way that no war could ever do. And mostly these demonstrations are chosen on a super conscious level totally unbeknown to the human personality. Only the being knows the growth and expansion that it creates through these scenarios. Only the being knows why it chose to be the one to participate, possibly for reasons relating to its own character and journey.

Step outside the “human” box for a few seconds and sense your own omnipotence. At that moment you may sense the magnificence of other beings that have gone before you, are here now and are yet to come.

Any one who has gone into battle in war could have chosen not to do so. There are a multitude of options available to not experience that. Any one who, as they say, fought the hard fight or took the higher road was definitely not taking the easy way or path of least resistance. These questions addressed here are a factor of perceptions. You must look deep to find answers that strictly relate to the “being” and not the human. When you look deep, you will be amazed at the deceptions that the human creates. You will be amazed at how the being operates in these seemingly mystical and omnipotent ways even while in a physical body.

I want to say to my favorite author and LOA expert, that you can not brush these historical incidents under the rug. You can not tell people “oh don’t ask that question and don’t think such negative and resistant thoughts”. You are not giving answers that way. You are just avoiding the question. At times you too prefer the path of least resistance. You worry sometimes that addressing certain issues will be bad press for you. I say practice what you mostly preach.
