			<content:encoded><![CDATA[<p>Determining the custody of your children in the state of Georgia just became a little more cumbersome for divorcing parents. As of January 2008, children age 14 or older of divorcing parents can no longer determine which parent they want to live with. In further attempt by the court to foster a cooperative relationship between the parents after divorce, it is now mandated by Georgia state divorce law that parents of minor children in every divorce case must submit a detailed parenting plan to the Georgia family court for approval.<br />
There are specific requirements to the content of the child custody parenting plan in Georgia which include which of the parents will retain physical custody of the child(ren), where the child(ren) will be every day during the year, how transportation will be handled including how the children will be exchanged between parents, where exchanges are to take place and which parent will pay for the cost of transportation. While many Georgia Family Law judges already required many of these stipulations be placed in a Settlement Agreement, this new procedures now make the process more uniform throughout the state. Additionally, by forcing a Settlement Agreement to contain so many specific requirements, proponents argue that there will be considerably less room for future dispute as to agreements being unclear or vague.<br />
In line with these changes, also required in the parenting plan are how major decisions about the child&#8217;s religion, health, extracurricular activities, education, and emergencies will be made along with how disagreements pertaining to these decisions should be resolved, as well as what limits each parent will have to information regarding the child&#8217;s school and medical records. The parenting plan also mandates whether a parent&#8217;s visitation with the child is to be unsupervised &#8211; if supervised, the details of supervision must be included in the plan to satisfy the Georgia child custody mediator during the divorce. The plan must also include specifics regarding limits of access to the children by phone or otherwise by one parent during the other parents time with the children.<br />
Another notable change that went into effect as of January 1st that will affect parents filing for divorce in Georgia is that the judge is now allowed to award attorney&#8217;s fees to one parent or the other. In most cases, this issue does not come up, but the legislation is designed to prevent a wealthy parent from using repeated stall tactics to lengthen the legal process. It is obviously in the best interest of both parties to retain attorneys in Georgia who are well versed in the application of the new Georgia state laws regarding child custody.<br />

			<content:encoded><![CDATA[<p>Most people assume that once a child custody order has been adopted by the court, it is final and cannot be changed. The fact is that any and all orders can be changed. Letâs take a look and see how and why. </p>
<p>Once child custody orders are adopted there is often a clause that states something about a significant change of circumstances must take place in order for either party to bring a motion to change the order. This language exists to keep the parties from filing frivolously just because they donât like the order. But the truth is that anyone can file a motion at any time. </p>
<p>Some of the reasons that parents might want to change the order are: </p>
<p>Most people worry that once there is a child custody order in place that some drastic must happen to file to change it. The reality is that the changes may be subtle and take time. One very clear example of that is the childâs age. When a child is an infant his mother may breast feed him. It makes sense that the mother would have primary custody (notice I didnât use sole custody) and the vast majority of the visitation time as fathers cannot breast feed. However, as the child grows older and is weaned from mothersâ breast a father that has been active and wants more time can petition the court to change the visitation citing the maturation of the child leading to less dependence on the mother. The significant change in this case is the dependence level of the child on the mother. </p>
<p>Other changes could be a parent who moves a significant distance away. This may require that the visitation be adjusted to find a more suitable balance in visitation versus commute time. But of course the biggest issue is the childâs safety. If some circumstance has changed that has increased the childâs level of danger, like a parent becoming involved with a convicted child molester. This is a scenario that requires that documentation be submitted to the court. Since many jurisdictions have their criminal cases available online, it can be very easy to look up someoneâs history. Make sure you get a copy of the final disposition of the criminal case to present in court in support of your case. </p>
<p>As you can see there are a number of issues that can be considered significant enough to ask for a revision of the visitation order. Donât let your child and yourself get locked into a bad situation because you didnât think you could change the order. Look for what has changed and how a specific change can make it better for your child. </p>

The recommendations specify a parenting plan that can include who has primary responsibility for making decisions affecting the child’s life, living/care and school arrangements and may also include recommendations for parents and/or child to address gaps or concerns related to parenting abilities.</p>
<p>The process ends with a disclosure meeting with parents to review the report; it may include parent’s lawyers also. They make sure that the information on which they are giving the child custody, are correct and both parents and lawyers understand the report and recommendations.</p>
<p>Even after a long discussion, I think that it will be better if parents try to solve this problem out of the court. By this process children really get hurt. It is my personal advice that keeps away your children from your personal problems. </p>
