Is a handwritten last will and testament, not notarized, valid/legal in Orange, California? Scope of validity?


will writer single, never married, assigned 1 person as sole heir to her assets/properties, dated February 24, 2004;

A handwritten will (called a "holographic" will) is valid in California (even if challenged) without a witness or notary, but it must be ENTIRELY handwritten, and unambiguous.

I am afraid that it will not stand up in court if it is contested. A will or living trust must be signed, notarized and witnessed. This is the law not only in California but throughout the USA.

As long as she was (how can I say this) still orientated Which means she knows her name ,where she is,why shes writing the will,date,time,year, get my drift

In many jurisdictions it would be. Holographic wills are generally self proving.

I think it is legal as long as no one objects to its validity
