What's the difference between a will and a testament?


Why are they always in the phrase together, "last will and testament?" What's the difference exactly? Can you have one without the other? My concern is who would become guardian of my child, not who would inherit any assets.

They are the same.

last will and testament n. a fancy and redundant way of saying "will." Lawyers and clients like the formal resonance of the language. Will and testament mean the same thing. A document will be the "last" will if the maker of it dies before writing another one.
