How does a last will and testament work?


You go to an attorney to write up your will, then what? What are the steps involved in writing, filing and executing a will?

In my state, you need to address several things in a will. First, who gets your stuff.

Secondly, there are several jobs you need to fill. You need to name an executor, who will follow the terms of the will and make sure that your wishes are followed. If you have minor children, you need to name a guardian to look after them until they reach the age of majority. You also nee a conservator to look after the assets that they will presumedly receive at that time.

The attorney will write the will following the proper form, and with the required language. One of the requirements is that you invalidate all preceding wills, so that there is no doubt about which one is the valid one. Finally, you need to sign the will. Optionally, you can deposit a copy with the local probate court. This makes easy to find when it is needed.
