Question regarding Last Wills and Testament. Can a husband and wife combine their wills into one document? |
I see many don't think it is wise. But what if both husband and wife agree on everything. What his is hers and what's hers is his. They are eachother's beneficiarys. ??? No. Husbands and wives today are regarded as separate individuals under the law. Each has their own property and succession rights that are different from each other's. Besides, what happens if they get divorced? No because one of you will precede the other in death. It is not a good idea at all. Each or consider individuals, and each needs their own Will. Protects each other and them self. Yes. That is extremely common. I would actually advise it so that you don't accidently write two different wills which contradict each other and cause problems for your heirs. Your wills should be two seperate documents -- each should have a section addressing your intentions if you were to both pass at the same time -- and those sections should match up. In some states yes, in some states no. But a very very bad idea. It can be done, but after the first one dies, it is no longer of any effect. Furthermore, even while both are alive, both are free to secretly or openly write a new will that cancels the old. If done in secret, then the other has no will at all. So, whatever you are trying to accomplish by a joint will, it is unlikely to be sucessful. |
