What kind of tactics will a lawyer use when plea bargaing with a prosecutor? |
A misdemeanor charge-will they look at the fact that the individual has no criminal history-honorably discharged combat veteran...leaving the scene of an accident-there was a mutual agreement that every thing was OK-there were two minor scratches on on the car the person who left....he returned within minutes -when he notice the indivdual was not leaving and was on his cell phone..he arrived way before the police came..no injuries...it was determined by witnesses that the person who called the police was at fault....no ticket to the individual but a leaving scene -misdemeanor..even if you leave for a second it is a valid charge. If they exchanged information and there was a mutual agreement then it was not a hit and run or leaving the scene of the accident. In Texas you are not required to call the police on fender benders. If they can get the prosecutor's golf schedual so as to hold it hostage to court proceedings, then he's got a real advantage. |
