California probation legal help is what i need?


i just got off probation for felony gta. it's been 5+yrs and never getting myself even close to someone who does that stuff. that's how i got in trouble in the first place. TRUST ME GUYS out there who still does it.....it's not worth messing up your life. CAN'T FIND A GOOD RELAXING OFFICE JOB! but anyways, i'm off probation now and i wanna know if i can get this felony dropped to a misdemeanor...or dismissed? but i still have restitution to pay off to the victims at the same time. i got some info from my probation officer on where i can go to get it dropped but i would have to pay about $30 to get my background printed out and then this service in downtown sacramento would help me do it if i am eligible. i just want to know cause i don't wanna waste $30 and then they tell me that i can't get it dropped til i pay off my restitution. which is a whole life paying.......well thanks for reading and please do leave me information if it can help me out somehow. thanks in advance.

If a state prison sentence was not suspended as a condition of probation, the court retains authority to reduce the case to a misdemeanor. Completion of probation also allows relief under Pen C 1203.4. Usually you are entitled to such relief if you successfully completed probation, but if you have restitution outstanding granting relief is within the discretion of the court. It is also likely that the court will not reduce the matter to a misdemeanor unless restitution is completed, but that is just a guess. These decisions are all up to the judge, not the probation officer, though the officer's recommendation might carry some weight.

If you cannot afford an attorney, you might wish to speak to the local Public Defender about this.

If you want to save that $30, and don't want to pay a lawyer, you can go to one of those legal aid socities, and get the same answers! If I were you, I would work on paying that restitution to your victims as soon as possible, but I think that felony will stay with you for a long time. From your question - I can't figure out if you ever did any jail time, just probation? If that's right, your are lucky! It seems that you have learned your lesson whatever you did, and want to make a life for yourself without that felony hanging over your head. I hope you have a job where you can make a decent salary, I don't know how much you have to pay the victims, but it might be a good idea to pay them by the week or month, whichever is convenient for you, but at least it will show them you are trying your best.
