Can a trustee be removed from a trust?

I have been asking for a copy of my Dads trust and will, since he passed 3 yrs ago, and have still not recieved a copy. What can do next to resolve this? I am named successor trustee, can I take over as trustee?

First, you CAN be both beneficiary and successor trustee. You don't say from whom you have asked for a copy? Has the will been entered for probate? Has the trust been funded (ie. had property placed in its name?)? Are there any assets of the estate? You need to answer these questions before anyone here can answer yours. Better yet, ask a local lawyer.

Some basics...
you cannot be both a trustee and a benficiary
Also, unless you are a beneficiary, you can be denied access to the details of a trust
Being named the seccessory trustee means that you can call for an accounting of the trust's corpus

You need an attorney
