Traffic ticket question? I got 3 violations on the same ticket, does that mean I got 3 points?


I got 3 violations on the same ticket, which is speeding (the cop didn't have a radar but said I was speeding), crossing the double yellow lines, and passing a stop sign. The clerk in court said it is 3 points but I heard you could only get the biggest violation counted against you. Is it true? Should I plead not guilty and fight the ticket? What are my best options and am I eligible for traffic school?

You have a good case. I'm saying ZERO points against you if you fight the ticket. If the cop had no radar on you, that claim will be dismissed. He's no mind reader or psychic. If that was the reason you were pulled over, the other tickets have to be dismissed as well.

Let me tell you something : Three tickets equals points for each ticket. Each ticket you described equals 2 points a piece so your looking at 6 points if you don't fight this ticket.

That cop can't write you a ticket for speeding if he had no radar...trust me.

EDIT: The answers below me is SO WRONG. You can NOT give someone a ticket for speeding if you have no form of Radar. That's ludicrous and crazy. What if the cops speedometer was off ? What if his GPS was not acting right on a cloudy/rainy day ? What if his compass didn't work right that day ?

Cops have to calabrate a machine designed to trap speeders. It is the only acceptable form of exact speed limits.
I would get a lawyer and counter their ticket with harassment is what I would do. Let the cop prove that he didn't harass you by giving you a speeding ticket that he had no proof of. If you listen to anything those other two said, I would feel sorry for you because they have proved they don't have any idea of what they are talking about...

I like the ones answer about having cops to guess out of 100 cars what kind of speed they were driving within 3 miles per hour, that made me laugh. That person needs a lawyer should they decide to goto the supermarket, so the lawyer can tell them what they can and can't buy.

if i were you i would ask to speak to the cop that gave you the tiket and ask him how he knew you were speeding so that should drop a point off and u wont hav 2 pay as much

Your best option is to call the county clerk and ask her if three violations on one ticket would mean three points on your record. I doubt it but it is good to ask someone who absolutely knows. Second, I would definitely recommend speaking witht he Judge and asking to do traffic school. This shows your sorry for your mistake and you want to fix it - Judges like this and will work with you.

Depends on in what state you live in. California's point system is different than Arizona's. They can charge you with multiple violations and they all count one way or another.

Traffic school is an option to lower your points.

Were you speeding?

Law enforcement officers are trained at the academy to judge speed. They are put thru a vigorous test, I believe approx. 100 cars traveling at different speeds, they must come within 3 mph of that car to pass (that is each car)

At least this is the way it used to be, could be wrong depending on the state you live in and things might have changed.

If you plead not guilty, you will be held to the same standard as a lawyer when you present your case.

I do not know what the probable cause for pulling you over, I can just guess it was a combination of estimated speed, crossing into an oncoming lane of traffic and not stopping for a stop sign. He had probable cause to pull you over. And finally, YES you can be charged for speeding even if there is no radar.

What the cop was doing is clocking you on his speedometer.
Just so you know, Their cars have global positioning. What that means is that if when they start their shift they go to a straight away, pick a hot spot, turn on global positioning with the satellite, run a certain distance and it will come back if their speedometer it correct.
