What is a good argument supporting tort reform? |
I need some strong points in support of tort reform...help if you can This begs the question of how you want to reform tort law! Most people talk of tort reform in the context of making it more equitable--capping excessive recovery and limiting punitive damages, winnowing out frivolous suits (especially medical malpractice suits) well before trial, moving to comparative damages from contributory negligence systems and improving comparative damages calculations, etc. The only reason to ever reform a legal system is because it isn't accomplishing what it was meant to do, or isn't fair. So if a proposed reform stands a good chance of doing that, that's the best reason you can have. But without knowing exactly what you mean by "tort reform" I don't know that i can answer your question! |
