What tort did Lee commit? And would he have to pay the money for the other car?


My brother Lee hit a parked car yesterday, and now Kelly(owner of parked car) says that we have to pay for the $1,200 in damaged. Is this right? Im taking her to court to see. Please help

This is a trespass to chattels issue. Your brother trespassed upon the other vehicle, and caused the damage.

Therefore he has to pay....but why are you in the middle of this?

Your brother hit a parked car, the owner wants to be paid for the property damage and YOU want to take her to court to see if she's right?

Wrong. Tell the owner of the vehicle your brother was driving to handle it.

You have this situation bass-ackwards.
