In Legalese, what is the most common phrase to mean the non-crime equivalent of "the elements of the crime"?


By non-crime I mean a wrongful action that's not considered a crime. Such as a tort or whatever. Anything that could reasonably be the subject of a civil lawsuit.

The term I am familiar with is "elements of the offense", this covers civil and criminal laws.
