Tort and contract?


What are the nature of remedies available in tort and remedies available in contract.

In torts, remedies are:

-Compensatory Damages (money to compensate injury)
-Punitive Damages (award to punish defendant for intentional tort)
-Nominal Damages (some small amount, like a $1)

In contracts, remedies are:

-expectation interest- (lost profits plus incidental/consequential damages minus avoided expenses )

-reliance interest- (damages can be computed based on expenditures incurred in preparing to perform or actually performing less any losses the breaching party can prove would have been incurred if the contract had been performed)

-restitution interest - (either the reasonable value of the benefit conferred (measured by replacement cost) or amount the benefited party鈥檚 value has increased.)
The goal is to put the breaching party back in the position it would have been in had the promises never been made.

(remedies at law)
-specific performance (courts enforce performance of something, like the contract)
-injunction (courts force you to stop doing something)
