Is it legal to tax bottled water?

I live in pa and work at a restaurant. A girl I work with said that it is illegal to tax bottled water, but another person I work with argued that it is completely legal. I just wandered what the real law on this was. Help please.

it depends on the laws of your state

No, PA law exludes "water" from any sales or excise tax.

Other non-alcoholic beverages (and food) are also excluded, but only if under 10 cents when purchased at an "eating place" or from a caterer (not including schools and churches...blahblahblah). Water is always excluded, regardless of how much it costs or where it is purchased.

I think it depends on what state you live in. I know here in Maine they tax everything.

umm idk? i thought it was but one day i was charged tax... so idk...
