Is it legal to hold money for someone who made more money than they're allowed due to social security rules? Nope. If SSA discovers that the person is hiding income to remain eligible for benefits, that would be fraud. The person would probably have to pay back the amount of benefits that SSA believed it overpaid a person and recieve reduced benefits. You yourself might also get in trouble if the government decides that the money you were holding should be counted as your own income for tax purposes. If person A earned the money but turns it over to Buddy to hold or he says something like"I can't take that money now, give it to Buddy", it is called "constructive receipt". He could have taken the money and spent it. A had control over it. A has to pay income tax on it and cannot avoid the tax on it by "assigning the income" to Buddy, even if Buddy agreed to pay the tax himself! i believe Andrew hit the nail on the head. Nuff said Why try it will show on a W2 or a W4 form unless it was cash and Uncle Sam won't find out if it was cash paid to him or her unless the other person rights it off on their taxes then in that case they are screwed. Let them or you get caught and find out. |
