Having my sister鈥檚 name removed from my disability nephew government checks? |
My sister has an adult son who has disabilities. My sister has taken off and not been home for 9 days. It is clear to us now that my sister is doing drugs. She is not answering her cell phone. This is the second time she has done this in a year. Last time she was gone for four days, and swore she told my niece. The police were called and a missing person report was done. She has not gone to work since she left. She has been seen in a different state close to us. My niece who is 21 lives with both of them with her new baby. My niece found out last week that she has not paid the rent, and they are getting kick out. They have only lives at this location for a year. They lived with me for 6 months prior. My nephew gets a social security check. What I need help with is getting my niece as his prime care giver and my sister鈥檚 name off of his checks. They can not live like this anymore. My neice wants to get her brother and herself away from my sister. This is a tough one. First, I would make an appintment to go talk to someone at Social Security. It's doubtful you have options through them, but let them spell it out. Chances are, you'll have to go through the legal system and you have no legal standing. Your neice would have to prove her mother unfit and file through the court to be named your nephew's guardian. Unfortunately this will not be an easy thing to do you will need a Lawyer and you will need to get this going in a hurry or she will have his checks for her drug use |
