Who will be the legal next of kin, children or a mother?


WHEN MY EX- HUSBAND DIED HE LEFT MANY ISSUES UNRESOLVED. SOCIAL SECURITY CONSIDERS OUR 11 AND 12 YEAR OLD CHILDREN HIS LEGAL NEXT OF KIN .BUT HIS MOTHER, THEIR PATERNAL GRANDMOTHER IS UNDER THE IMPRESSION SHE IS THE NEXT OF KIN. WE HAVE SOME DOCUMENTS OF IS WE NEED BUT THEY CAN ONLY BE RELEASED TO THE NEXT OF KIN. WE LIVE IN TEXAS , WHO WOULD THIS BE.

Children will come first as their guardian ad hoc (parent) you can get those documents legally. No court is going to award his mother any money or property -that belongs to his kids not his mom.

No social security will go to his mother ever. That doesnt happen. Your children can recieve social security though and you should apply for it. Your ex left the kids a nice monthly check until they are 18 or in college its 22. Apply at the social security office. Its not welfare. Your ex worked for it.

No, wives are first, then children, then parents, then siblings, etc.

Next of kin or next of kid? Because a 'kin' is like the word 'kind' but without the 'd'. A kid is like a child, you know, an infant but larger.

Depending on the situation it could either be his children or his mother. Under social security it is his kids they get his benefits however many other things would go to his mother. you may have to seek out a lawyer to sort all of this out. if it has to do with insurance benefits,a house,or anything else legal find yourself a lawyer for in the long run it will be worth the money spent.

Your spouse is first and foremost your next of kin than if you don't have a spouse and you have children your children are your next of kin if you don't got neither a spouse or children your parents are next of kin

So your ex MIL is wrong Your children will receive SS benefits and if he had property or money once your children turn 18 it will be theirs

His children would be next of kin but since they are underage I'd contact an attorney.
