My daughter passed away, and I have her 13yr. old daughter. What steps do I need to take to get child care.?


My daughter was receiving child support at the time of her death. The child support was coming from her ex-husband who lives in another city. My daughter has a 13yr. old and a 21yr. old. Her children will be receiving her social security. After receiving the death certificate, what steps will I have to take.

You will need to contact the social security office to apply for the survivor's benefits for you granddaughter. The 21 year old will not be eligible for SS benefits sinec he/she is over the age of 18. You will also need to file for guardianship/custody of the child in order to have the legal right to make decisions about your granddaughter, so you might want to hire a family law attorney.

Be aware that the 13 year old's father has the legal right to custody of his daughter now that the mother has passed away, so you might have a custody battle on your hands.

I'm sorry about your daughter, but i know nothing about child support because i am only 13.

There are a few groups out there that help grandparents who raise their children's children.You do have some rights so check with your local social service agency to guide you in getting assistance. You may also need to check with a legal person in regards to the child support continuing. Good luck and so sorry for your loss.

Contact an attorney
Get Custody papers as you will need them to get information on her until she is 18.
Contact CPS if you have any questions, they will be able to help you with anything that you need.

I cannot answer your question, but I just wanted to send my heart felt condolences. Losing a child at any age is the hardest thing a parent can be put through. My prayers are with you.

Go to the courthouse, apply for legal guardianship, then request that the father's support checks come to you now until your granddaughter is of legal age. If he's checks don't start coming, you can go to "child support" advocates to get help.

Take the death certificate to the Social Security office and you might also check with the welfare department, if for nothing else to get medical coverage for the 13 year old.
She is the only one that can receive death benefits by the way.
The 21 year old is not eligible. Too old even if the 21 year old is a full time student.
One more thing. The father only has to pay for the
13year old and since your daughter has passed, he may want the children to live with him.
If not, he should continue to pay the support to you.
