Sexual harassment in the work place?


I hav worked at my job since last september and since the 1st or 2nd week that i hav been there my general manager has been very innapropriate. He has touched me, he has come on 2 me. he will call me late at night when i am here alone and we hav a camera where he can watch from his house so i cant lie and say that i have a customer 2 get off the phone. so i stay on the phone and listen 2 him talk. I am nice 2 him because he is my boss and other than the sexual harassment he is a semi-nice guy. I have told some of the other managers about it. they tell me he is always doing this to young white girl that work here. at least 5 or 6 so far, they all quit though cause they could not deal with it. they have asked him 2 quit for me... so they tell me. but he just keeps on. i stand up more for my self now when he does it, like ill hit him if he grabs my butt or my sides. I talked to a lawyer, but they need money upfront and i dont have it. I need some advice PLEASE HELP ME. he tryed 2 kiss me!

i have spoken to several people in the community they tell me that since he touches me when no one is around i have to proof and a couple people who know him tell me that he has been fired numorous times before for this. the people who hired him this time no its his last chance and thats how they controll him here. we are not a corprate propertie we are a franchise or a huge companie and they dont have a complaint dept. i know all the girls names that he did it to before. i know people who say they will testify for me. i just cant find a lawyer . they dont have sexual harrasment lawyers in our phone bgooks and i call attorneys to get recommendations and they send me in circles. i have said forget about it several times cause i get frustrated and just say ill live with it. but like today he came in and walked up behind me and put his arm around my waist and put his pelvis against my butt, i wanted to vomit! I hit him in his arm and told him 2 get off me and i walked away. he is horrible

Call the Equal Opportunity Employment Commission (EEOC) and they will be all over this guy AND your employer. The facts you cite support a very good "hostile environment" case against the employer, as well as a laydown harassment case against your pervy boss.

And look for a lawyer that will represent you without up-front money. This is a case that can be handled on a defendant-pays basis thanks to Title 42 of the US Code.

If the manager is black, he may feel he is protected by the legal system to act as he chooses. I would think a white manager in any company would be aware that he is fired if you can file a credible human rights complaint under your state's Human Rights Commission. A women's' political action group such as NOW should assist you in prosecuting your claim against the manager. Exhaust your administrative remedies before filing a lawsuit. Look in your local phone directory for the women's organizations that advertise its services for women to include legal services. Sometimes, female lawyers in the divorce specialty have a general appetite for female causes. You could try on of them; however, you need to talk to "outside the office" friends who can keep a confidence.

Given the history you describe you need to document your situation with management. Using your corporate email (puts the report in the corporate record) send a formal complaint to his boss. Management is required to take action. If you do not take this step all the diaries and complaints to your hairdresser about "emotion distress" will have far less impact. That stuff comes from bad TV.

If management does nothing and the situation does not improve I would document the situation in another email. Then if nothing is done go to the EEOC.

If, after your complaint, you are subject to retaliation document the occurrence and go to the EEOC immediately.

Sexual harassment or any type of harassment case is very difficult to prove. You will need record of each incident, how it made you feel, and any impact it has had on your performance. Also you will need to provide names of anyone who witness the acts and any other records that can support your claim.

Depending on where you live you may have to file a comlaint internally or go to a complaint board in regard to sexual harassment. Without records, names, and evidence you will have a very difficult time proving your complaint.
