If someone reports you of sexual harassment in the workplace, what rights do you have and what can happen? UK?


Someone reports you of sexual harassment in the workplace:
1. Do you have the right to know who's reported you?
2. Will the police get involved?
3. What's the worst outcome?

Many things are weighted against you

1. Social Stigma.
2. Not knowing who reported you.
3. Questions may even be loaded against you.
4. A Company must be seen to take stern action.

If you are entirely innocent, and the allegation made by a person with an axe to grind, or just hates you, or has been spurned by you, or you made a casual remark that just does not fit the PC mode of the time. You can still have your name muddied forever within the company (''There is no smoke without fire'') is one cliche.

Most love a scandal, and you must not be innocent in some people's eyes.

If you have been reported and you are innocent, you must seek help immediately (it will not go away).

A good Solicitor that specialises in these cases is totally necessary.

Not only do you need to clear your name, but you must follow through and sue the person that has made the claim.

When you win, a Public Apology must be gained, and the rest of the staff fully informed that you are again willing to sue if ever the subject is raised again.

If you are innocent, this could completely ruin your working life.

If you are guilty?...Well, tough!, you deserve everything that is thrown at you.

Sacking, court case, possible imprisonment if it constitutes sexual abuse or rape.

(1) You are entitled to be treated fairly. You cannot defend/comment about the complaint unless you know all of the details.
(2) If the harassment amounts to criminal behaviour the police may well ge involved, but company's normally prefer to deal with these matters under employment law internally as they don't want adverse publicity.
(3) Fired and or a criminal record if the police get involved.

Do take professional legal advice or at least consult your union rep if you are a member.

You will never know who reported you unless it goes to court, the police will be involved if its very serious, it could go to a employee tribuneral (not sure if thats spelt right) you may be charged, sacked, and become someones toy in prison!

the police might get involved depending on how serious the allegations are
and the worst out come is prision if rape was the aligation or get fired..... you have the right to know what was said though
