How do I sue the HR department of my company. I was falsely accused of sexual harassment? |
Facts: I am the project manager for a large janitorial company. An african american janitor, genre female, lied and accuse me falsely of sexual harrasmente. Employer promotes her to supervisor. can you PROVE that you were falsely accused?? You can certainly start the inquiry with a lawyer but you want to document every occurance of such allegations. The employer doesn't appear to have a tremendous problem with her activity if they in fact promoted her, so you will definitely have a fight and your employer will NOT necessarily be on your side. You can't sue just the HR department. You would have to sue the company. These types of suits are very difficult to prove, much less win, unless there was actual proof that the company was negligent or reckless in handling the complaint, or you have actually suffered damages. If you are still employed, despite the complaint, then you problaby should just forgive and forget, and move on. |
