What is a sexual harassment?


How do you know that they (!) crossed the line? What is "too much"?

Although QueenLori gave you a good reference, there really is no right answer to your question. The matter is one of fact for which a court will be required to decide.

Suffice it to say, that if an action makes you feel uncomfortable, whether it be of a sexual nature directed at you or not, then you may have grounds to file a complaint of either sexual harassment or hostile workplace.

The specific designation depends on the facts of the case.

By the way, third-party sexual harassment is a growing field of study and issue before the court now. An example would be a group of workers around the water cooler tell an off-color joke loud enough that you hear it in your cubicle. While this does not specifically define sexual harassment, it does (under current third-party case law) rise to the level of a hostile workplace.

The issue is NOT regarding just "that is sexual in content". In fact, sexual harassment can be any number of things, including a joke without any sexual connotation which a person subject to such finds offensive.
(And on the above, I'm reminded of the potatoe and catapillar cartoon from the Drew Carrey show).

Also, while you are NOT required by law to file a complaint with in-house HR, you do require a "Right to Sue" letter from your state EEOC authority before the court will entertain any such suit against the offender.

The practical method of resolution (as I advise) is that you file a WRITTEN complaint to your immediate supervisor (with a copy to the head of HR and a copy to yourself) and within that letter, may a demand that the incident be addressed and a reasonable solution be executed.

Be forewarned however that what you may deem reasonable the company is under no obligation to concur. They may remedy the situation by reassigning the offender, having a consultation with the offender or decide that nothing of an illegal or offensive nature has taken place and do nothing.

Your rights under the law are ONLY that the behavior stop and the company addresses the issue. HOW they address it is not at issue unless and until suit is filed.

If you file with your state EEOC before attempting to resolve or mitigate the situation, it is most likely that you will not receive any satisfaction as it is not the EEOC's job to litigate for you.

So, write the letter with full details, send a copy to your supervisor, HR and yourself and then wait to see if anything changes. If it does not, file a formal complaint with your state EEOC and attache your copy of the demand letter.

If a liberal does that it is a personal matter and should smear the victim at all cost.

What is too much? That is up to the victim or determine by the liberal who is charge with it.

I worked in HR for 10 years it is anything that is sexual in content, even if they continue to ask you out. After you have told them to stop and you have no interest. If it continues and makes you feel uncomfortable or threatened then see your HR director, not the assistent the director.

incredibly enough, it is up to the person being persecuted. it follows under many acts: touching on any body part, even if it's meant just to intimidate; making lewd or suggestive comments, verbal or written; leering; stalking; leaving suggestive or explict material in public areas or areas where they know u will frequent. etc, etc, etc.
now, i do have personal feelings towards this issue. is the "harassment" actually directed towards u, or do u just happen to walk in or overhear a conversation? if that's the case, u may just need to get some thicker skin. people talk about thier sexual encounters, and if that is all that's happening, i doubt it's directed towards u, unless u can prove that it only occurs when u r around.

Any sexual innuendos, references, or inappropriate behavior towards you that makes you feel uncomfortable!

I agree with Servantof God and let me add that sexual harrassment can be on either a man or woman. Both can feel victimized.

If you feel you're being sexually harassed, for the love of god tell the person yourself first. Dont be a whiny ho and tell your boss about it. The "harasser" has a right to know first. I swear letting women in the military is one of the greatest mistakes of this country
