Wouldn't be sexual harassment unless you're pinching his ***, but in either case, it'd technically be assault.

But if you're concerned about how your boss would react to it, then you shouldn't be touching him under any circumstance. People these days don't respond too well to unwanted contact.

Pinching your boss is not sexual harassment because you are the subordinate but it constitute as unjust vexation since he will be offended.

If you are worried about it- don't do it! There are a lot of elements that go into sexual harrassment. I would be more concerned if it would be considered a battery (unwanted physical touching). FYI- there is no guide book on what is or isn't sexual harrassment. It is a case by case analysis. Keep your hands to yourself- I'm sure your boss's partner would appreciate it.

BTW- you can be sued for sexual harrassment if you are a subordinate- contrary to the answer by someone else.

No, that may not be considered sexual harassment because of the following reason:

1. Pinching is not an act considered as sexually abusive.
2. Hierarchy or subordination is an essential element to establish sexual harassment, at this instance you have comitted the act and not your boss hence no subordinatio.
3. If the intention is merely to annoy then may only qualify for unjust vexation.

I suggest pinch your boss but dont get yourself over it might just lead to slight physical injury or worse.
