Can a maid file a non-sexual harassment charge against her employer?


My maid, Maria, has threatened to do just that. I suppose that she thought because she is quite attractive, that I would persue her.

Well, that was not the case. The main reason I hired her was not because of her looks, but because she has very large hands. I thought, and I still think rightfully so, that she would be able to dust and clean much quicker.

Now she just pouts and says I don't want her. I still want her. But not that way.

Very large hand- eh? Just think of the other services she could render unto you. All those soothing back rubs and relaxing massages and ......

Dump her. This could turn into trouble in the long run. She's expecting sex and if you don't come forth with it, she could make the whole employer/employee relationship turn very ugly.

She is your employee. Why do you care what she thinks? She was hired to clean and that is what she should do. There is nothing there for her to sue you and your question is dumb.

No, I think you can't file a non-sexual harassment charge, because its your word against hers. If you think that she is capable of doing that then you may have to look for another maid. if she can't understand your reasons for hiring her in the first place, you can try to explain it to her, but if she doesn't accepts that then look for another maid. you never know what people are capable of doing once they misunderstand something.

LOL....I would Double-Dog Dare her to do just that. I would like to see the look on the law-clerks face when she tries to explain how it is the right of every maid to be sexually harassed..

On the serious side, you really should get a new maid. This lady sounds like she is clearly a bit crazy and it is just a matter of time before she does something really bad.

Yes now days you can get in trouble for any harassment;sexual or not; which is good i guess as ys ago the judge would of laughed a case out of court; but today the take battering verbal abuse ; sexual and just plain assault.very serious.

She does have the right to file a lawsuit if she truly believes she has a valid claim. But it sounds to me like you could get it dismissed from the start based on the fact that she doesn't really have a claim. There are certain elements you need to prove in order to have a successful claim, and you have to show some valid facts at the very least which would indicate harassment occurred.

I would caution against keeping this woman around, she sounds like one of those crazy ones.

Not to mention, lawsuits are generally quite expensive...and somehow I doubt Maria is such a successful maid that she has the money to hire competent legal representation.

So what is the problem with Maria, obviously a Mexican-Puerto Rican girl no doubt, or perhaps from Cuba. Anyway since you stated in your story I donot find the link between the question and your situation.

You didnot state here if you FIRED her or terminated her from her job. Did you? Non-sexual harassment charges against you? Did you touch or do something to her to think otherwise here? It seems your short description of things are too short, we couldn't comprehend if you are guilty or not. Since most people who describe things eliminate their guilt to make people sympathize on their own flight. I see the same in your case. But plainly speaking, regarding your question, she has the RIGHT to file CHARGES against you.

give her a dirty Sanchez and say "THERE... HOPE THAT MAKES YOU HAPPY"
