Okay folks, I need help and the topic is sexual harassment.? |
A close someone was harassed sexually by a female. She said she wanted to tickle this person's knee, so she went ahead. He was wearing shorts, so she started working her way up his inner thigh. He did kick away, but then she came onto him again and said something in Spanish. She said "What, is your d**k small or what? What's the size?" He was confused, didn't know what to do because usually guys aren't the ones in this position. Another incident happened less than a week later, this time she was caressing his feet with her own. She said she was trying to remove his sandal, but it was more than that. She left the sandal and was stroking his feet and going up his leg yet again. So my question is: is this enough for a lawsuit? There were two witnesses in both instances, me being one in both cases. Plus she's continually harassed him. The lawsuit is to gain a restraining order. She has no case against him but I'm afraid no one will believe him because he's a guy. I am distressed over this. I'm sorry I did not add enough details. Okay so for starters, this is not at work, this is actually at college. For the guy that said "rock her world," I am forbidding that, as this guy is my boyfriend. He has told this girl to get off his back on more than one occasion. As this did happen in October (I don't remember if I stated that or not), the reason I'm talking about it now is because this past weekend he told her to stop and stay away from her. She went to school officials and told them that he was aggressive towards her and tried to hit her. Folks, first of all my boyfriend is very timid, and nothing that she makes him out to be. He has a family lawyer, and the lawyer has said to go on with it. But like someone stated, I do have the right to fear. Men being sexually harassed is not a common practice in the United States. I do have everything documented, including a witness' statement. If this girl cries in court or mentions her false accusation, I do fear the worst. Did this happen at the work place? And if so did he report her? If he is serious about getting a restraining order he has to do that first and give his place of employment a chance to rectify the situation by first bringing her in to discuss the situation with her. And then if that doesn't work dismissing her. If they don't act up and do what they are supposed to do then he has a lawsuit against the company. It is enough for a lawsuit, but in sexual harrassment cases, the court usually favors men. But still, what she said was pretty offensive, so if there are witnesses, then yes. yes, it's sh, but the law system tends to go with the women in the sex-harassment cases. Your fears are well-founded and probably accurate, but you gotta try. Was this in the work place or are we just talking about a guy who wont tell this chick to get lost? Do you have enough money to pay a lawyer? Unless this chick has money and will be a big payout your lawyer will want you to fork it over and up front at that. I think it would work out best to have your friend grow a set and tell the chick to back off. he needs to come right out, in front of others, and tell her that he doesnt appreciate her actions.. if he continues to let her do it without making it perfectly clear that he doesnt like it, then she will continue... the comment about size was totally inappropriate.. but he truly needs to, in public, tell her he finds it harrassing and would like her to stop.. then, if that doesnt work go to the personal office... good luck sexual harassment should not be tolarated by anyone, male or female. Tell him to report this employee to management and be sure they know he has witnesses. I hope this harasser isn't his supervisor. sexual harassment go to both male and female,if this is at a job,it is harassment,go to the boss and tell everything.write down on notebook of what the harasser done to the person. It is. But before this goes to court, has it been processed up the chain of command at your company? It doesn't really matter much that he's a guy. If you guys saw it, that should be enough proof seeing as there really is no hard evidence for sexual harassment. 3 people's words against one should do the trick. that is sexual harassment and should have been reported the moment it happened..its not to late since there are witnesses but something needs to be said right away...talk to the human resources department..then go from there...but let them know that you are ready to get a lawyer.... If hes a man the he should be a man and handle it...tell her to get lost its not going to happen...or rock her world.....You are telling us enough is this at work.....or is this happen in a swingers club.....come on never hurts to try and witnesses an all sounds like st least you've got little something Is this happening at work? If so let management know ASAP He must make it know that he considers her behavior unaceptable and uninvited. He should then walk away from her. If she continues in this manor it would be considered sexual harassment. Is she really that disgusting? a threesome would solve the problem and would be fun. |
