Harassment or Assault?


I'm a little gray about what constitutes assault and is reportable or not.

My ex husband is an alcoholic, and often comes over late at night, drunk, wanting to see our daughter who is always in bed by the time he gets here so I'll tell him no and he'll act like he is going to leave, then he'll put his hands on me- my butt, my breasts, etc. When I push his hands away, he doesn't put up a fight, but it's always a chore to get him to leave afterwards because he starts saying he wants to come inside and "talk" to me and sometimes starts crying. He was abusive when we were together, but my 3 year restraining order expired against him and because he had completed anger management counseling, I couldn't get another reinstated. I've been told by one source that what he's doing is a form of sexual assault and another says it's just harassment. Which is true and is it grounds for a new restraining order?

Before anyone says anything, I answer the door when he comes over because if I don't he starts knocking on windows and I don't want him to wake my children up, which would only lead to more trouble.

Actually, it is considered to be assault and battery. An assault is mental and involves creating fear. Battery involves nonconsensual physical contact. Assault and battery are both legal torts, and one action can be considered to be both. What he is doing is definitely reportable and grounds for a new restraining order! Please go get help from the police. At least go seek legal council.

Harassment

In my state that action is called Gross Sexual Imposition. A felony. Call the police.

This is assult! Report it to the police. To get a protective order. It could get WORSE!!

You are dealing with both.When there is force applied it is assault, but it is also harassment. I would began calling the police when he shows up, that way when or if you need to file a restraining order or get an E.P.O. you will have police reports to back you up.

Call the police and tell them that the abuse is still going on. Fight for another restraining order. . Call the police every time he comes over drunk and/or touches you in an unwanted way. Get a lawyer to find out if there is anything else you can do. If you continue to allow this to happen it's going to get worse.
