I am studying some law cases and we recently covered sexual harassment and in one of the cases, a female employee got angry at her male supervisor and kicked him in the groin. He quit work over the incident, filed a sexual harassment lawsuit and won. Do you believe that he should have won the harassment law suit. You have not supplied enough facts. If the kick was delivered with hostile words, such as "you men, you're all alike" then there was an actionable tort, but in order to hold the employer liable, he had to show that the employer created or facilitated the situation. yes. the workplace should be a safe environment for all workers. If you let that go, then everyone at that company would think its OK to kick a co-worker. Yes, she touched him in a private area, albeit with her foot in a violent manner. The point is that she violated him by touching him in a Private area. You think a kick in the nads by an angry butch isn't harrassment? Harassment is the same for women as men, he was touched by her foot inappropriately. No, it wasn't sexual harassment, but maybe he was harassing her sexually. I would have to know the whole story. |
