Is it assault to throw a snow ball? |
I've been following the story of the guy who threw a snowball at a fellow workmate and is being charged with assault. Now I find out that he is also being charged with sexual harassment for brushing his hand on her behind. I have been reading and listening to the news and I thought the snowball hit her on the back? It depends on who it is and the relationship between the thrower and the throwee. I read that story; they are prosecuting a foreign student for throwing a snowball. What is really sad is that he will probably win his lawsuit and those who truly and justly should win their lawsuits, will not. It is easily harassment if he did it before, especially if it was intentional. Unintentional? Not harassment, but if he has made other advances towards this person then the brush on the booty is easily seen as intentional. Either the harassment has gotten to such a bad point that she is offended by every little touch as she is afraid it was meant in a sexual way, or she is trying to use every little moment and turn it into a lawsuit and make money off of it. Either way is sad. He didn't just "throw a snowball". ..."any" action that would tend to put someone in fear, harm or in jeopardy would be an "assault" upon them... coupled with the actuality of being "hit" by the "object" (snow-ball) now constitutes a "battery"... (I know, I know...it was a snow-ball at a ski-resort)... but... in our ultra-Political Correct, Liberal, ACLU, "dummy-cratic" guided society. "Grandma" could be charged with a crime for "kissing" you on the cheek if you were offended... I write from the UK I do not often read other answers prior to submitting mine, in this instance I did luckily, Many answers give opinions that are not, fully conversant with the facts of this case,It would appear from a more <informed person> that, the snowball in question was in fact, ICE, and it hit the lady on the back of the head,Who then required stitches,that is, an assault, the action of placing his hands on this lady without, her permission could be, construed as an assault, and possibly upheld in a court of law. |
