Restaurant Employee Rights?


I am a busser at a restaurant and a few days ago a waitress claimed to have seen 3 dollars (tip) on the table and later when she went to pick it up it was gone. There were three other bussers on that night and he immediately pulls me outside and accuses me of taking the money (I didn鈥檛 take it). Anyway he then proceeds to say he is going to (expletive) break my legs and kill me if he sees me taking money. Besides the fact that this is completely unprofessional, are there laws against death threats in a work environment? I know there are laws against sexual harassment but are there laws addressing threats to employee well being? I know many people who answer will be just to suck it up and let it go. But, just out of curiosity what is manager employee rights or edict. All input is appreciated.

LAW: Hostile work environment , no employee shall be made to feel uneasy or threatened while working. (short version)

Couple things in this story --
Threat of bodily harm is against the law as well.
however , proving it is another story - and even once proved , getting something done, well that's another road.
It was most likely at your table ( assuming each buss has a zone) but still to single you out (unless you know for a fact he talked to the others) would be discrimination.

My advice - look for new work. Once you find a new job report your old work to your states employment agency or the better business bureau.

I think this event should involve the manager/boss of the workplace. or you could even quit your job and find another more suitable and less hazardous workplace!

If you had written your state and city it would be more help in giving a suggestion. With the At-Will Employment Doctrine and many states that have the "Right to Work State" you have almost no protections nor rights and this is why the 2 leading parties just do nothing to help people like you.

Write everything and see if your state has a agency where to complain. If you have people who are witnesses it is your word against theirs. Workplace violence occurs more than it should just a yahoo search

Find another job and quit before being fired since over 200,000 Americans are wrongfully terminated annually and as stated the 2 leading parties rarely talk about this unless it gets them into office or reelected.

Yes there are law to protect you from threats, not just in the workplace. You need to go to your manager and report the employee. If the employees is still threatening you , and the manager does nothing.call the police and make a terroristic threatening report. then call your managers supervisor and report him for not taking care of the problem.
