What amendments have been violated by the Homeland Security Act ?To Mr. Goodhi 漏 and in vino veritas,
Exactly how does the Homeland Security Act violate these amendments?
Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
Amendment VI

Please tell me exactly how any amendment is violated...Or is your only source some liberal talking head that said the Homeland Security Act violates the Constitution?
Since its enactment, has any CITIZEN been subject to an unreasonable search or had his/her property unreasonably seized? Since its enactment has any CITIZEN been held to answer for a capital or infamous crime without an indictment from a Grand Jury? Since its enactment has any CITIZEN been refused a speedy trial or a jury? Maybe you should try reading the Constitution some time. It is amazing what you will find in it.
Like: Article I Section 1. All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.
Apparently Congress did have the Constitutional authority to create and pass the Homeland Security Act.
You might also notice in Article I Section 7:
Every bill which shall have passed the House of Representatives and the Senate, shall, before it become a law, be presented to the President of the United States; if he approve he shall sign it, but if not he shall return it, with his objections to that House in which it shall have originated...
Apparently the President approved the Homeland Security Act and signed it into law.
I have my sources, where are yours? Rosie O'Donnell, Bill Maher, and the dailykos.com don't count as credible sources. The rights promised to the people in the Constitution only apply to CITIZENS of the United States. They do not apply to foreign nationals, prisoners of war, or suspected terrorists that are NOT CITIZENS of the United States. Maybe your bleeding heart liberal professor forgot to mention that in Political Science 101 at your bleeding heart liberal college. Or maybe you were sleeping through his/her lecture that day.
To answer your question, no Amendments have been violated by the Homeland Security Act. What's wrong guys? Was it too difficult to find facts to support your fraudulent claims? Report Abuse
