How much can Food Co. fine me for shoplifting? |
I gave it all back and it was under 8 dollars. I will never do it again, but he did say I will receive a fine in the mail and if I didn't pay it would be turned into a warrant. They took my id number and my address. Then they let me go. No signing and no cuffs or even cop cars. I think they may have just been store security. It was humiliating and embarrassing. Never again. They can't fine you....only the civil authorities can do that. I'm not sure about the amount but do not let anyone tell you hat they can't fine you because they can. was it atleast the store LP (loss prevention)? b/c i know stores get mad when u shoplift. i work at old navy & ugh i hate it when i catch people stealing we all just intimidate them but there are certain things we can & cannot say to them to prevent a law suit. maybe the store took it the extra mile & told u they were gonna fine u. i mean YOU did give them your information. u gave them things willingly, they cant touch u or anything. thats why stores hire an LP, so the liability isnt on the store. they can fine you for a couple hundred dollars. it is called a merchant or shoplifting fee. while other have noted that it is a civil penalty against you, if you do not pay it. it becomes a criminal matter, and you get to go to jail for violating a court order to pay. it depends on the food company's policy... you should be able to look up their policies online... i would imagine no more than $250 - $500 ... the point is you were caught shoplifting, it doesn't matter how much! They usually have a set fine... and you should just be thankful they didn't call the cops, even though it was a small amount it is still a misdemeanor and you would face fines and community service...plus a record. In some states, a merchant can seek a civil damage award (in KS I think it is $250 if I remember correctly). It is not a fine (although they may call it that). It is statutory damages for theft. Think of it as small claims court without the court. You should be more concerned with how much the courts can fine you. Shoplifting is a crime and you should be arrested, convicted and sentence according the laws of your respective state. The _merchant_ does not have power to exact fines except for 'bad check fee' and surcharges for the use of credit cards. They cannot fine you as such, but they can ask you to pay a settlement in return for not being prosecuted. There's no limit on the amount. If you think it's too much, you have every right to refuse to pay and let a judge decide. man f that. lol they fined you lol. I would just tell them to show you a police report that you stole something. I mean what evidence do they have against you? ps would they take it to court? Is the worth to them good enough to pay lawyer/court costs? i shoplifted when i was 14, got caught, and was arrested. they let me go afterwards, and i had a fine of $150 A store security guard has no authority to issue fines or warrants. If they were just store security, i wouldn't worry about it. I wouldn't have even gave them my real name unless it was a real cop. Assuming this is in the U.S. I don't think they can fine you personally without calling the cops. I bet they were just trying to scare you into not doing it again. In the UK only a recognised court or police officer can issue fines. Anything else is a civil matter. Commercial organisations can dispense justice in your country? Very peculiar.
