Is a statement admissable in court if a threatens to shoot you while he is interrogating you.?


I basically told the cop i dont know nothing. joking with him cause i knew him he was security guard more than a cop but i jokingly said if you dont believe me then you can shoot me in the hand and then he yell you want me to do that cause imma blow your damn hand off and then he started to knock stuff off the counters.So i was wondering is that type of behavior allowed?

In the US, police officers may not coerce a statement from you by using actual violence or the credible threat of violence.

Whether his display of temper was coercion or not is up to the judge to decide when you file a motion to suppress your statements.

If: 1) you made a statement, 2) there was proof of the officer's conduct, you could probably get the statement excluded as a coerced confession.

However, cops are very good at keeping their bad behavior from being provable and it doesn't sound like you made any incriminating statements. Not knowing anything is not an admission, and there's no statement to use against you, so there's nothing to exclude.

Probably not but cops will often appear to not think rationally, it's a mind game to get you scared of them. I've found that being diplomatic can turn them around, and they'll stop playing games with you if they don't think you're playing games with them.

Walk away, respect this officers authority. It sounds like you may have instigated this issue.

No, it's abusive and threatening.
