Made false confession to security guard took blame for friend?


now I'm being prosecuted do I have any defenses?

A confession is not enough to support a guilty plea. They need evidence as well. Speak to your attorney and explain what happened.

Your defense is just as you described - that you were protecting a friend and the statement is not true. It's not the easiest defense in the world, but definitely not the hardest either.

You would probably have to take the stand, in order to get any evidence of your defense before the jury. That's risky in its own right, because you are then subject to cross examination by the prosecutor, and, because if you have prior felonies they will come in if you take the stand.

But really what should happen is this: your attorney will explain what happened in opening argument. the prosecutor will present the case against you, which will consist of the security guard's testimony, and maybe your written statement too (but more likely just testimony). If the prosecutor truly has no other evidence, then that's the end of their case.

Then it's your lawyer's turn, and s/he will have to put you on the stand (unless there is a way to get the security guard to testify that you might have been lying to protect your friend). You'll tell your story, the prosecutor will cross examine you and try to make you sound like a liar.

Then both sides get to give closing arguments.

It's definitely winnable, but also definitely not a guarantee. It'll depend on how convincing you are and whether you're a better witness than the security guard (and whether you have a better lawyer than the prosecution).

If you want to take the fall for your friend, you are stuck.Why would you do this? A friend would not let you take the blame, and this will affect you for the rest of your life. Call the investigating officer and if it is not too late, you may get a lighter sentence.tell him what happened. If your Friend doesn't like it, he or she is no real friend.
