Finances of the mentally ill,any help UK only?


My uncle is currently in an nhs psychiatric low security care facility.
He is not sectioned or under a restrictive order. His condition has
improved slightly.He believes that now my aunt should now restore
his accounts to himself.She was only ever looking after it during his illness.
We are now worried that if he gets sole access again he will withdraw
it and possibly do something unwise like disappearing to london.
Does the law require an order for us to prevent him doing anything
with the money. I know this sounds unfair but he really is not
capable at the moment and his memory fluctuates.

depends on his disability, if he is not stable in his meds, his consultant could argue that he cannot fully function and then your aunt could get a power of attorney to look after his affairs until such time that his consultant is happy. other than that not being sectioned means he can do as he pleases. Have a word with a solicitor regarding what is a very thorny issue, if he can fend for himself, there may be nothing you can do as he is regarded as fully compus mentis.

If he has not been certified, he can do what he likes with his accounts, and there is nothing you can do.
