Cought shoplifting at Walmart?


I was cought at Walmart shoplifting something that was 2.65 but cops weren't call and security told me that just to respond to a letter that Walmart will be sending me soon, can they still prosecute me for that?

In most states, there is a period of at least one year in which you could be charged with a crime. Since the police were not called when you were stopped by loss prevention, chances are you will not be charged with a crime if you pay the amount that Wal-Mart will be requesting in that letter. If you don't pay, you'll get sued in civil (non-criminal) court, and they might decide to call the police to file a police report.

That letter you are going to get is called a civil demand, and every state allows retailers who are the victim of shoplifting to use civil demand. They can demand an amount that is usually between $300 and $650. That money is to cover their costs of catching you shoplifting. If you don't pay, they can sue you, and then you'll have to pay the amount above, plus their legal costs (lawyer) as well as Court costs. It'll be cheaper just to pay the civil demand amount.

It would have been a heck of a lot cheaper to have just bought that $2.65 item. Now it's going to cost you hundreds of dollars. And you will pay that amount. Wal-Mart attorneys can be vicious about getting the civil demand amount, which means filing civil suit.

you can still be prosecuted... most laws that any one breaks has a certain amount of time in which a prosecutor can charge somone criminally. i forget what it is called.... but ya you can be.

Do not respond to the letter, other than denying what it states. Otherwise you may be confessing to something.

why steal something that only cost 2.65?
