Waiting for a civil deman notice to come home?


My little siter, 11, got caught shoplifting for an amusement park. It was a 14.99 beach towel. The undercover security took her to a small room and questioned her. Soon after they made her sign her a piece of paper and informed me that i would be receiving a fine in the mail from Civil Demand Associate. How does this work since she is under 18, and they did not ask me for my information, meaning the fine will come out to her name. Shes not legal, nor is she even close to being legal. I guess my question is will she be billed for it? THe only information they have down in her birthday and her name. no ss#. not even any of my information.

I live in California. I was contacted, since I was her guardian for the day and I'm at the legal age. I was reunited with her, and they informed me a bill will be sent home. but im curious to how its to be handled, since she is a minor.

You must not be in America

In the United states, Minors (under the age of 16) cannot be served a summons, warrants or any such court documents. Those papers have to be served on the parent/custodian or legal guardian or guardian adlitum who is responsible for the child's welfare.

In most cases, the child's parents or another responsible adult would be contacted and if no adult could be contacted then Child protective services would be called to take custody of the child or an D.O. (detention oreder) would be requested at the local level magistrates office in order to keep the child in protective custody at juvenile detention until the parents or a responsible adult guardian could be contacted.
