Would I have to go to court for this?

Last night I came home at 2am and there was a suspicous looking pick up truck sitting infront of my neighbors driveway running with its lights on. I got a little concerned because some cars were broken into a few months back and I thought there could be a possibility of the house getting robbed. So I decided to slowly drive by the car and noticed there was a man in the drivers seat passed out and slumped to his right. I called the cops and they all showed up and it took them awhile but they finally got him to wake up. The came and questioned me about what I saw. They asked for my license, home address, phone number, social security number. Now my question is are they going to ask me to go to court to say I was a witness or anything? The only reason I ask this is because I leave Sept. 8th for Boot Camp and would not be able to make the court date. If I had to go to court would I be able to get out because I am going into boot camp? I figure I am probably not a vital part of the case.

I forgot to mention the guy was completely plastered. I remember hearing something like 3-4-5-HOLY ****! I have no idea what it was referencing to but Im sure it had to do with his intoxication.

No telling. In all likelihood the prosecutor could handle the case without you. If you do not receive a subpoena, then you need not attend. It is a bit early to sweat it. If you get a subpoena, call the prosecutor and tell him/her about the problem.

I doubt if they actually need you to testify in person. If they need your statements at all, they can probably use a deposition (They would ask you questions under oath outside of court.) This could be done before you leave, or they could come to your base and do it. Your testimony is probably not that critical because the cops saw him in the same condition as you did.

First of all, you did the RIGHT thing. you took action because you believed that something was going down. The driver was probably passed out from drink or drugs. Either way he was a potential danger to himself and others.
If you tell the authorities about your concerns about Boot Camp etc. then they should be understanding. If you decline/refuse to turn up then the guy walks as you may have been the only witness.
Last of all, YOU did the right thing!

I see no reason why the DA is going to want to call you.

If you "do" get a subpoena or witness summons (Same thing, different States just use a different term), call the lawyer that issued it and explain your situation.

If they insist they need you (and, again, I *really* don't think they will), show the summons to your recruiter.

Have fun at Basic :-)

Richard

I would say they gathered your information because they want you to be a witness. You should call them and inform them that you are going into boot camp and that you can not be a witness for them.

you generally dont go to court for reporting a crime. and they just need your information to write the report.he was probly drunk and got a DUI,so your most likely in the clear.

you wont go to court you didnt witness a crime or anything

they took your info to verify you belonged there thats it you did your part they have your statement they are through with you

Not likely.

Nope.
