I got fired for asking someone to leave my store because their child had feces running down her leg, help!?


i work in one of the nation's largest specialty retailers. I noticed that the child had feces running down her leg and told her dad if he wanted to go change her and come back that would be great. HE LOST IT! started calling me F**kin f***got, telling me he is going to kill me and that i had better watch out every night i get off work. I called mall security and they refused to escort the man out of the mall even after witnessing the guy telling me all this. My regional manager said that I should have let the feces fall on the floor and cleaned it up afterward. There is no hazmat wear in the store and I dont believe that is correct. Do I have the ability to sue?

he did not buy anything and hadnt been a customer since 2006

i think i would take this to the labor relations board. if your original job description makes no mention of baby poop. i am almost sure you have a cause for action, or actions.
your boss fired you for non specific reasons without a review of standards and practices. bad form

if mall security allowed the man to use profane and disgusting language; and took no action then they are accessories in job harassment. your work place is to be free of harassment of any kind.

i would take this to a couple of lawyers. two or more before you sigh n the dotted line and i would raise the roof. it has to be worth at least a years salary plus lawyers fees.

theoretically you will not have to go to court. you will get an outstanding reference from your previous employer ((don't go back to work there however)) and the mall may find some special perks to throw your way. good luck
