Should I file a lawsuit?


I had a complaint and took it to HR and it was a written complaint. When I requested a copy of my personnel records HR failed to document the complaint and what they did to address the complaint. From this complaint retaliation escalated and my working condition became intolerable. So I went to HR again and explained why my working condition is intolerable. I revealed my supervisor allowing illegal burning of movies and downloading of songs, emulation of how Asians spoke with broken English and laughed about it (I'm Asian), no working relationship and my supervisor became misleading and my 2008 review reflected it. I wrote a dispute to HR concerning my personnel records being inaccurate and by law they must make that dispute part of my personnel file. I also wrote a rebuttal to my review pointing out how my supervisor was misleading and I have proof from another employee who was a witness. They had to dig deep to fire me and they came up with security breach. Happy to share the breach.

I have copies of what I submitted to HR...as far as emulating how Asians speak and laughing about in front of me is strictly their words vs mine...but I did document it. The breach of security is my blog of How To's. Exposing the IP address of our firewall and my name was justified the security breach. I had a how to create a VPN site with the site IP but no credentials. My supervisor said that the potential for security breach was there. There is a reason why VPN passwords are long and have combinations of letters and numbers. Plus there is a monitoring system on the firewall so that if someone does come knocking repeatedly that it emails or send text message to my supervisor's phone and he has the capability to handle attacks from home. My point is without credentials it's difficult to break into anyone's network. By saying there's the potential, well, there is pontential security breach when emailing username and passwords to our customers both when they register and request them.

It sounds like you may have case of harassment. I would contact a lawyer who specializes in such cases to see what they think. Whatever was used for an excuse as a "security breach", was it specific or general? Were you the only one to do this, or is this something that others do as well? I hope you kept track of everything that was going on, times and dates of occurrences. Did you keep copies of anything that you submitted to HR? The more tangible evidence the better. If it is your word against theirs, it can be more difficult. If you have others who will corroborate your claim, it will help.

Wow! I'm sorry you went through all that. Sounds terrible.

Usually the best thing to do in these situations is find a different job.

You might be able to sue, but it is expensive and time-consuming and the outcome is unknown (trust me, I work in the legal field).

You should definitely talk to a lawyer. He can explain the process and tell you if he thinks you have a good case. Find a lawyer who specializes in employment law and will take your case on a contingency basis.

Also, you can file complaints with your state's labor department and the EEOC (the Equal Employment Opportunity Commission).

I would first check with DEIR - have attached their site, contact them and see what they say, contact legal aid services who can give legal advice. Sounds like a bad workplace, also are a member of the unions as they can assist!!!!!

Move on, shake it off. Why would you want to work at a place like that. They don't deserve a person of integrity.

It sounds like you have grounds for a suit. You are going to need to find a good lawyer as your first step.
