Can a child get Social Security Benefits if the father died before the child was born?

I was wondering if this was possible, they weren't married...so who even knows if the child was his or not. What can you do legally to prevent this from happening, especially if you don't think he is the father. Who would have the authority to advise against DNA, the mother of his three minor children (not married) or the deceases parents?

Social Security is a benefit a child gets when their parent paid into it.....And I care because the deceased is my childrens father.

Maybe. You would have to have paternity established through DNA testing, with the father's parents or full siblings as the matches to your child's DNA. It'll probably take an attorney to get all this accomplished.

My cousin's daughter was able to get social security for her daughter even though the father died about a month before the baby's birth. That was an easier case, however, because my cousin was married to the father of her child and paternity was presumed based on the marriage.

If the mother petitions the court for paternity only the court can decide if DNA testing will be allowed.

Try getting a job and supporting the kids like the rest of society instead on becoming another Section 8 dependent.
