It is really important I find this out. Can I legally do this at work?


Everytime a trucker comes here I have to take a copy of there drivers liscence. I live in Missouri but they always complain and say it is illegal do that. I was wondering if someone knew the law or if they knew where I would have to call to find out. I heard it was illegal in Iowa and that is who usually complains. Anyone know or know how I would find this out? I am the Supervisor of Security and I am the one who is suppose to find this out I guess.

You don't need to bother with the law in other states where the truck drivers may be based. The only laws that are going to apply to you are the laws of the state of Missouri and federal law. Turns out there is no law against making a copy of the drivers license under federal law or in your state.
In fact, if you're collecting the information for Shipper Endorsement or TSA Shipper Security purposes, you're required to review the ID.
Another person stated that you can not make a full color reproduction. This isn't entirely true, but you would be required to have the words "COPY" clearly printed across the face of the copy.
When the truckers from other states complain, just say, "Yeah, well you're in Missouri now."

Yep, not illegal at all under the Patriot Act. I can't remember the URL but this is also covered on a Dept. of Homeland Security site.

As another said it does have to be black and white. You do have to set certain security procedures in place. The copies do have to be secure and access to them has to be strictly limited. This will cover your butt if someone complains.

Just review the patriot act. Because it's truckers and security and with recent threats, you can take copies. Just be ready to detail where you'll keep the copies, what happens with them once you have them, and will you have to keep providing copies once you have a master copy???

Well that depends upon what you do, if verifying their identity is essential to providing the service or a necessity of security it is entirely legal.

As long as you are using a monochrome photocopier. It is actually a big no no to make color copies of legal documents, including government issued ID.

If that's what your job requires you to do, then you must do it. Just say, "Show me" your license
