Obtaining a Harassment Restraining Order in Georgia?


I have questions about obtaining an HRO in Georgia. I have recently been "stalked" by an ex-friend of mine. This person has admittedly broken into my car, at least once that I am aware of, and will not stop contacting me.

I'm not sure what to do about the case, but I no longer feel safe, even on my school's campus, where security is supposedly looking out for their students.

I'm curious about who to contact, what the cost is, etc. If anyone could answer these questions for me I would really appreciate it.

Just go down to the court house and tell them that you want to file an Injunction Against Harassment or Restraining Order (basically the same, with minute differences).

You'll have to fill out a report and go before a judge (same day). They'll either grant it or won't.

Usually no charge.

If they do grant the injunction... you'll take home both copies of the court order... call the non-emergency when you get home... and have them serve the defendant. Sometimes there's a charge for serving (around $25).

After the defendant has been served he or she will have the opportunity to appeal the injunction. In this case, both of you will be required to appear in court and plead your cases.

If you don't show up, and the defendant does, the injunction will be removed and discarded.

You can only get a temporary restraining order until a court hearing is held.

But you need to call the court clerk in order to apply for one.

If you don't know where that is, go to the local police station and ask for help. Or call one of the non-emergency police numbers found in the phone book.

Go down to your local police station. All you have to do is say that you are in fear for personal safety. I don't know how much it will cost where you live, however if there is any fee it will be minimal. It is a good idea to document everything, dates, places, etc. for future reference if need be.
