Can Social Security Wages Be attached?

Someone has defaulted on a personal loan. The loan has been documented. They work, but my suspection is that if their wages were attached they would quit and just go with social security. They have forged documents to get social, so this isn't someone I feel bad about taking those wages. If I were to take this person to small claims, would I be able to get a judgment on attaching their social security?

SSI payments are considered poverty level payment therefore, they are not attachable. However, SSDI payments are attachable but for only certain circumstances such as child support, taxes owed to the government, student loans, and state taxes owed. Other than those three reasons an individuals SSDI payments can not be attached.

However, if the individual is committing fraud with the SSA, by all means go on the SSA website and place a claim against the individual for fraud.

The only thing Social Security can be garnished for is for Federal and State Taxes and Child Support. So, keeping that in mind, if its not Child support, I would still take them to small claims court or you'll be out your money.

WITH THE INFO YOU GAVE OUT, THEY COULD LOSE THEIR SOC BENEFITS TOTALLY. BUT SOC SEC CAN BE GARNISHEED.
