The security at a club tackled me with my arms wrapped around so I fell on my face, what can I do.?


I got in a minor scuffle outside a club and am a pretty small guy 5'5 120 and I did hit someone outside a bar at a high profile amusement park like Disneyland. After the first swing, the security guard which are typically over 6 feet 200 lbs tackled me with my arms tied up by their arms. I slammed to the ground face first and now my face is scarred, bleeding, scuffed up and it hurts as hell. Well we went home after that and everyone is telling me to sue. I don't know what I can do because I did get into a fight, but still is that eccessive force, couldn't they just choke me out or something. I mean even a guy that weighs the same as me can do that let alone a huge security guard. Now the questions is, we don't know which security guard did it and don't know how to go about this. Please help as I don't want to wait too long to report this

You have only yourself to blame.

Next time, don't get into drunken fights outside bars.

You are lucky the park didn't arrest you! A choke is deadly force, so tackling you and smacking your face a bit got you off lucky. Security had every right to stop you from doing what you admitted to be doing. Chalk it up as a lesson learned and quit trying to blame someone else. All your friends are idiots. You will start something you can't win.

Depends on how much you want to sue for and the cost of your injuries. Doesn't sound like you went to the hospital or was seen by a physician. I do not see a criminal case here, the security guard is not a law enforcement officer, his defense is going to be he used just force to protect the other guest. You may still be able to get a few thousand by an out of court settlement. It just depends on if you want to spend all the time finding a lawyer to handle the case, getting witness, and lots of paperwork.

Start at the beginning. What is the name of the business that you were a customer? OK, get on-line and find the corporate page. Look on that page to see if there is a contact email or phone #. Call to find the correct department to complain about the actions of security.

Call or better yet, GET a lawyer. Was there any kind of report made about the incident? If so, you need a copy of this.
I don't know if you have a case, but if you do, then there has to be some evidence of the incident and the names of the security guards should be listed as well as any witnesses. If you have a witness, then that person's name will need to be added. Good Luck. You will need a lawyer that specializes in injury.
DO NOT STATE THAT YOU ARE GUILTY -- LET THE LAWYER DEAL WITH THAT.
