What can i do to protect myself from being forced to pay back money i didn't take?


i was working last night and i was alone except for one matiance man. when i had to go to the bathroom he came up. at one point during the night a 100 dollers went missing. now i know i didn't take it, and i called my manager the second i reliezed it had gone missing. they don't beleive it was me who took the money, however i am the one that is being held responicible. my job is forcing me to pay back the money. now mind you there is no cameras and one of the tills has no locks. the only thing my boss has ever told me is to never leave the desk unintended. they never mentioned to me how to keep the money safe when i am alone. they assume i know. note this is the first job i have ever worked with money with and very little security.
i am not sure what i can do please help

It is probably more of a case of you being responsible for your drawer and your money than an accusation of theft. You did leave your drawer untended, so you are responsible for it. I understand you had to go to the bathroom, but if there was no way to lock the drawer, that was the chance you took.

If you are in the US only thing that the company can do legally is fire you for the suspicion of the theft and or call the police.

It is illegal for them to take money out of your check without a court judgment.

Furthermore, if you did not take the money and they fire you, you can sue for wrongful termination and slander if they ever accuse you of the theft in front of others.

You will have to pay it back or risk losing your job....your choice.....employment at will.

Don't give in to threats! Do not give them money (it will admit guilt) Stick to your story. Ask to see their policy on these matters. Sign nothing unless you wrote it.
Tell them you know your rights (and learn them in the mean time) and that they will have to take you to court to get it back. They will probably drop it because it will not be worth it.
If they call the police, DO NOT talk to them. Say nothing unless you are charged. Then talk to an attorney. You do NOT want this on your record! Say that you want representation and plead the fifth ammendment (refusal to self-incriminent yourself) if you are charged. TAKE THIS VERY SERIOUSLY AND BE FIRM IN YOUR DEALINGS WITH THIS!
