Can an employer change your rate of pay for the same job?


Can they change my rate of pay for same job same work?
I work for a security company... every time I get my paycheck my rate of pay changes for the same job site. The first paycheck I got 7.40/hr second paycheck I got 8.72/hr now the third paycheck is back to 7.40/hr!! Can they legally do this?

Unless you are under contract or union protection, probably; but odds are something else is going on here. Ask HR or your boss.

You should go to your HR department though. It may have been a mistake.

They can't move you below your base pay rate without telling you first. If they tell you they are going to start paying you less, it can be effective immediately (but NOT retroactively), and your only recourse is to quit. But they can give you more than your base pay if they want to. They might do this if you have a shift differential.

Based on all the given facts, I think they may have screwed up when they paid you extra. I would recommend bringing it to their attention, though. They may let you keep it, but on the other hand, if they discover it later on without you telling them, they might just dock a future paycheck to make up for the difference (and if you have unexpected bills, this could hurt).

Well, lets see.
You agreed to work at $7.40 an hour.
You got $8.72 an hour by mistake and they corrected it and took the loss themselves.
